That the volume of hazardous and nonhazardous materials\n\ntransported by motor carriers within this state is substantial and\n\nthe need exists to improve the enforcement of safety related aspects\n\nof motor carrier transportation for both interstate and intrastate\n\nmotor carriers which is consistent with federal standards and\n\nregulations.\n\n2. That hazardous materials are essential for various\n\nindustrial, commercial, and other purposes, that their\n\ntransportation is a necessary incident to their use, and that the\n\ntransportation is required for the economic prosperity of the people\n\nof the State of Oklahoma.\n\n3. That the highway movement of hazardous and nonhazardous\n\nmaterials poses a substantial danger to the health and safety of the\n\ncitizens of this state unless such materials are handled and\n\ntransported in a safe and prudent manner.\n\n4. That it is in the public interest and within the police\n\npower of the state to provide for the regulation of the safety\n\nrelated aspects of motor carrier transportation and the handling and\n\ntransportation of hazardous materials.\n\nB. It is therefore declared to be the policy of the State of\n\nOklahoma to provide regulatory and enforcement authority to the\n\nOklahoma Department of Public Safety to improve safety related\n\naspects of motor carrier transportation and to protect the people\n\nagainst the risk to life and property inherent in the transportation\n\nof property, including hazardous materials, over highways and the\n\nhandling and storage incidental thereto, by keeping such risk to a\n\nminimum consistent with technical feasibility and economic\n\nreasonableness and to provide uniform regulation of intrastate\n\ntransportation of property, including hazardous materials,\n\nconsistent with federal regulation of interstate transportation.\n\nC. It is not the intent of the Legislature to regulate the\n\nmovement of hazardous materials in such quantities that would not\n\npose a substantial danger to the public health and safety, and the\n\nDepartment may provide for exemptions as provided for in federal\n\nregulations for farm use, and other appropriate exemptions\n\nconsistent with federal regulations.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b260785d8a5f7bf0c013e33b407433181896f1b5e5c32d9fa6a7543670ee3096","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-230.18","next":"us-ok/okla.-stat.-tit.-47-47-230.21"},"notice":"GroundRules: Original legal text.
