Stat. tit. 47, § 47-230.23","heading":"Definitions","body":"As used in the Motor Carrier Act of 1995:\n\n1. “Person” means any individual, firm, copartnership, limited\n\npartnership, corporation, limited liability corporation, company,\n\nassociation, or joint-stock association and includes any trustee,\n\nreceiver, assignee, or personal representative thereof;\n\n2. “Commission” means the Oklahoma Corporation Commission;\n\n3. “License” means the license issued under authority of the\n\nlaws of the State of Oklahoma to motor carriers and private\n\ncarriers;\n\n4. “Interstate Registration Certificate” (IRC) means a document\n\nissued by the Commission granting permission to operate upon the\n\nhighways of the State of Oklahoma in interstate commerce exempt from\n\nfederal motor carrier regulation;\n\n5. “Motor vehicle” means any automobile, truck, truck-tractor,\n\ntrailer or semitrailer or any motor bus or any self-propelled\n\nvehicle not operated or driven upon fixed rails or tracks;\n\n6. “Motor carrier of persons or property” means any person,\n\nexcept a carrier of household goods or used emigrant movables,\n\noperating upon any public highway for the transportation of\n\npassengers or property for compensation or for hire or for\n\ncommercial purposes, and not operating exclusively within the limits\n\nof an incorporated city or town within this state. Provided, the\n\nprovisions of the Motor Carrier Act of 1995 shall not apply to the\n\nfollowing vehicles and equipment when such vehicles and equipment\n\nare being used for the following:\n\na. taxicabs and bus companies engaged in the\n\ntransportation of passengers and their baggage, not\n\noperated between two or more cities and towns, when\n\nduly licensed by a municipal corporation in which they\n\nmight be doing business,\n\nb. any person or governmental authority furnishing\n\ntransportation for school children to and from public\n\nschools or to and from public-school-related\n\nextracurricular activities under contract with, and\n\nsponsored by, a public school board; provided, that\n\nmotor vehicles and equipment operated for the purposes\n\nshall qualify in all respects for the transportation\n\nof school children under the Oklahoma School Code and\n\nthe rules of the State Board of Education adopted\n\npursuant thereto.\n\nc. transport trucks transporting liquefied petroleum\n\ngases intrastate which are owned or operated by a\n\nperson subject to and licensed by the Oklahoma\n\nLiquefied Petroleum Gas Regulation Act, and\n\nd. transportation of livestock and farm products in the\n\nraw state, when any of such commodities move from farm\n\nto market or from market to farm on a vehicle or on\n\nvehicles owned and operated by a bona fide farmer not\n\nengaged in motor vehicle transportation on a\n\ncommercial scale;\n\n7. “Corporate family” means a group of corporations consisting\n\nof a parent corporation and all subsidiaries in which the parent\n\ncorporation owns directly or indirectly one hundred percent (100%)\n\ninterest;\n\n8. “Intercorporate hauling” means the transportation of\n\nproperty, by motor vehicle, for compensation, by a carrier which is\n\na member of a corporate family, as defined in the Motor Carrier Act\n\nof 1995, when the transportation for compensation is provided for\n\nother members of the corporate family;\n\n9. “Private carrier” means any person engaged in transportation\n\nupon public highways, of persons or property, or both, but not as a\n\nmotor carrier, and includes any person who transports property by\n\nmotor vehicle where such transportation is incidental to or in\n\nfurtherance of any commercial enterprise of such person, other than\n\ntransportation;\n\n10. “Market” means the point at which livestock and farm\n\nproducts in the raw state were first delivered by the producer of\n\nthe livestock and farm products in the raw state, upon the sale\n\nthereof;\n\n11. “Public highway” means every public street, road or\n\nhighway, or thoroughfare in this state, used by the public, whether\nan\n\ntransportation;\n\n10. “Market” means the point at which livestock and farm\n\nproducts in the raw state were first delivered by the producer of\n\nthe livestock and farm products in the raw state, upon the sale\n\nthereof;\n\n11. “Public highway” means every public street, road or\n\nhighway, or thoroughfare in this state, used by the public, whether\n\nactually dedicated to the public and accepted by the proper\n\nauthorities or otherwise; and\n\n12. “Commercial enterprise” means all undertakings entered into\n\nfor private gain or compensation, including all industrial pursuits,\n\nwhether the undertakings involve the handling of or dealing in\n\ncommodities for sale or otherwise.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2799c91bbc34a241647cb4dd17f0877455ce48e2487bd2dd6e2746cc69cffa54","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-230.22","next":"us-ok/okla.-stat.-tit.-47-47-230.24"},"notice":"GroundRules: Original legal text.
