It shall be unlawful for any motor carrier to operate or\n\nfurnish service within this state without first having obtained from\n\nthe Commission a license declaring that all insurance requirements\n\nhave been met and that the carrier will operate within all existing\n\nrules and state laws pertaining to safety standards, size and weight\n\nrequirements and, when applicable, lawful handling and disposal of\n\nhazardous materials and deleterious substances, and will operate in\n\nsuch a manner as to ensure there will be no detrimental\n\nenvironmental impact. It shall also be unlawful for any private\n\ncarrier to operate or furnish service within this state without\n\nfirst having obtained from the Corporation Commission a license\n\ndeclaring that all insurance requirements have been met and that the\n\ncarrier will operate within all existing rules and state laws\n\npertaining to safety standards, size and weight requirements and,\n\nwhen applicable, lawful handling and disposal of hazardous materials\n\nand deleterious substances, and will operate in such a manner as to\n\nensure there will be no detrimental environmental impact. The\n\nCommission shall have power, and it shall be its duty, to issue the\n\nlicense or set the application for hearing within thirty (30) days\n\nof the Commission determining that the application is complete. Any\n\nsuch hearing shall be scheduled to occur on a date within an\n\nadditional forty-five (45) business days of such determination. The\n\nmere filing of an application does not authorize any person to\n\noperate as a carrier.\n\nB. In granting applications for licenses, the Commission shall\n\ntake into consideration the reliability of the applicant; the proper\n\nequipment meeting minimum safety criteria as adequate to perform the\n\nservice; and the applicant’s sense of responsibility toward the\n\npublic and the environment.\n\nC. The Commission may, at any time after a public hearing and\n\nfor good cause, suspend or revoke any license. Provided, the record\n\nowner of the license shall be entitled to have ten (10) days’\n\nwritten notice by certified mail from the Commission of any hearing\n\naffecting the license, except as otherwise provided in the Motor\n\nCarrier Act of 1995. The right of appeal from such order or orders\n\nshall be given as in other cases appealed from orders of the\n\nCommission.\n\nD. The Commission shall be authorized to exercise any\n\nadditional power that may from time to time be conferred upon the\n\nstate by any Act of Congress. The Commission shall adopt rules\n\nprescribing the manner and form in which motor carriers and private\n\ncarriers shall apply for licenses required by the Motor Carrier Act\n\nof 1995. Among other rules adopted, the application shall be in\n\nwriting and shall set forth the following facts:\n\n1. The name and address of the applicant and the names and\n\naddresses of its officers, if any;\n\n2. Full information concerning the physical properties of the\n\napplicant; and\n\n3.
