Stat. tit. 47, § 47-230.4","heading":"Powers and duties of Commissioner","body":"To the extent necessary to administer the Oklahoma Motor Carrier\n\nSafety and Hazardous Materials Transportation Act, and consistent\n\nwith budget and manpower limitations, the Commissioner:\n\n1. shall adopt and promulgate rules and regulations in order to\n\ncarry out the provisions of the Oklahoma Motor Carrier Safety and\n\nHazardous Materials Transportation Act relating to motor carrier\n\nsafety in the transportation of property and hazardous materials in\n\nintrastate and interstate commerce, and to coordinate the\n\nimplementation of a transportation emergency response system;\n\n2. may adopt by reference and enforce all or any portion of the\n\nfederal motor carrier safety regulations and the hazardous materials\n\nregulations of the United States Department of Transportation, as\n\nnow or hereafter amended;\n\n3. shall conduct a continuing review of all aspects of motor\n\ncarrier safety and the transportation of property, including\n\nhazardous materials, in order to determine and recommend appropriate\n\nsteps to assure safe transportation;\n\n4. may authorize any officer, employee or agent of the\n\nDepartment to:\n\na. conduct investigations; make reports; issue\n\nsubpoenas; conduct hearings; require the production of relevant\n\ndocuments, records and property; take depositions; and conduct\n\ndirectly or indirectly research, development, demonstration and\n\ntraining activities,\n\nb. enter upon, inspect and examine at reasonable\n\ntimes and in a reasonable manner, the records and properties of\n\npersons to the extent such records and properties relate to motor\n\ncarrier safety or the transportation or shipment of hazardous\n\nmaterials in commerce, and to inspect and copy records and papers of\n\ncarriers and other persons to carry out the purposes of the Oklahoma\n\nMotor Carrier Safety and Hazardous Materials Transportation Act,\n\nc. stop and inspect any driver or commercial motor\n\nvehicle for any violation of the Oklahoma Motor Carrier Safety and\n\nHazardous Materials Transportation Act or rules and regulations\n\nissued pursuant thereto,\n\nd. declare and mark any transport vehicle or\n\ncontainer as out of service if its condition, filling, equipment or\n\nprotective devices would be hazardous to life or property during\n\ntransportation, or if records thereof reflect such hazard, or if\n\nrequired records are incomplete,\n\ne. prohibit any commercial driver from transporting\n\nhazardous materials if such driver is unqualified or disqualified\n\nunder any federal or department regulation, and\n\nf. administer and enforce the provisions of the\n\nOklahoma Motor Carrier Safety and Hazardous Materials Transportation\n\nAct and any rules and regulations issued pursuant thereto.\n\nAny such officer, employee or agent shall, upon request,\n\ndisplay proper credentials prescribed or approved by the\n\nCommissioner.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cf3585c2261f0756c69dc34c9eaf830bd81c360aaaea06d8730e65483dd010dd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-230.34b","next":"us-ok/okla.-stat.-tit.-47-47-230.5"},"notice":"GroundRules: Original legal text.
