Stat. tit. 47, § 47-230.6","heading":"Certain uses and activities of vehicles and containers","body":"prohibited.\n\nA. No person prohibited from operating a commercial vehicle\n\nshall operate such commercial motor vehicle, nor shall any person\n\nauthorize or require a person who has been prohibited from such\n\noperation of a motor vehicle to operate a commercial motor vehicle.\n\nB. No person shall operate, authorize to operate, or require\n\nthe operation of any vehicle or the use of any container when the\n\nperson has been placed out-of-service or the vehicle or container\n\nhas been marked out-of-service until all requirements of the out-of-\n\nservice order of the person have been met or all required\n\ncorrections for the vehicle or container have been made; provided,\n\nupon approval of the Department, the vehicle or container may be\n\nmoved to another location for the purpose of repair or correction.\n\nC. No person shall remove an out-of-service marking from a\n\ntransport vehicle or container unless all required corrections have\n\nbeen made and the vehicle or container has been inspected and\n\napproved by an authorized officer, employee, or agent of the\n\nDepartment. No person shall return to duty unless all requirements\n\nof the out-of-service order have been met and the person has been\n\napproved to return to duty by an authorized officer, employee or\n\nagent of the Department.\n\nD. No employer shall knowingly allow, require, permit or\n\nauthorize an employee to operate a commercial motor vehicle:\n\n1. During any period in which the employee:\n\na. has had driving privileges to operate a commercial\n\nmotor vehicle suspended, revoked, canceled, denied or\n\ndisqualified,\n\nb. has had driving privileges to operate a commercial\n\nmotor vehicle disqualified,\n\nc. is not licensed to operate a commercial motor vehicle;\n\nprovided, this subparagraph shall not apply to any\n\nperson who is the holder of a valid commercial learner\n\npermit issued by the Department in conjunction with a\n\nClass D driver license,\n\nd. has more than one commercial driver license; provided,\n\nthis subparagraph shall not apply to any person who is\n\nthe holder of a valid commercial learner permit issued\n\nby Service Oklahoma in conjunction with a Class A, B\n\nor C driver license,\n\ne. does not have the proper class or endorsements on the\n\ndriver license or commercial learner permit, or\n\nf. is in violation of any restriction on the driver\n\nlicense or commercial learner permit;\n\n2. During any period in which the employee, the commercial\n\nmotor vehicle which the employee is operating, the motor carrier\n\nbusiness or operation, or the employer is subject to an out-of-\n\nservice order; or\n\n3. In violation:\n\na. of a federal, state, or local law, regulation, or\n\nordinance pertaining to railroad-highway grade\n\ncrossings, or\n\nb. of any restriction on the driver license or commercial\n\nlearner permit of the employee.\n\nE. An employer who is determined by the Commissioner to have\n\ncommitted a violation of subsection D of this section shall be\n\nsubject to an administrative penalty of not less than Two Thousand\n\nSeven Hundred Fifty Dollars ($2,750.00) nor more than Twenty-five\n\nThousand Dollars ($25,000.00).\n\nF.
