Each person involved in an incident or accident during the\n\ntransportation, loading, unloading, or related storage in any place\n\nof a hazardous material subject to the provisions of Oklahoma Motor\n\nCarrier Safety and Hazardous Material Transportation Act shall\n\nimmediately report, by telephone, to the Department if that incident\n\nor accident involves:\n\n1. a fatality due to fire, explosion, or exposure to any\n\nhazardous material;\n\n2. the hospitalization of any person due to fire, explosion, or\n\nexposure to any hazardous material;\n\n3. a continuing danger to life, health, or property at the\n\nplace of the incident or accident; or\n\n4. an estimated property damage of an amount to be determined\n\nby the Commissioner by regulation.\n\nB. A written report shall be submitted by the person to the\n\nDepartment on a form prescribed by the Department, or in lieu\n\nthereof, a copy of the written report submitted to the United States\n\nDepartment of Transportation. Each report submitted shall contain\n\nthe time and date of the incident or accident, a description of any\n\ninjuries to persons or property, any continuing danger to life at\n\nthe place of the accident or incident, the identity and\n\nclassification of the material, and any other pertinent details.\n\nC. In the case of an incident or accident involving hazardous\n\nmaterials which is not subject to the Oklahoma Motor Carrier Safety\n\nand Hazardous Material Transportation Act but which is subject to\n\nTitle 46 or Title 49 of the Code of Federal Regulations, the carrier\n\nshall send a copy of the report filed with the United States\n\nDepartment of Transportation to the Department of Public Safety.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"89dcb592e8892bebd9a9c1fa201f0533b3dd7cc50a7077a3ca4c3e42b5ffb80d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-230.7","next":"us-ok/okla.-stat.-tit.-47-47-230.9"},"notice":"GroundRules: Original legal text.
