The Executive Director of Service Oklahoma shall be\n\nappointed by the Governor with the advice and consent of the Senate.\n\nThe Executive Director shall serve at the pleasure of the Governor\n\nand may be removed or replaced without cause. Compensation for the\n\nExecutive Director shall be determined pursuant to Section 3601.2 of\n\nTitle 74 of the Oklahoma Statutes. The Executive Director may be\n\nremoved from office by a two-thirds (2/3) vote of the members\n\nelected to and constituting each chamber of the Oklahoma\n\nLegislature.\n\nB. The Executive Director of Service Oklahoma shall be the\n\nchief executive officer of Service Oklahoma and shall act for\n\nService Oklahoma in all matters except as may be otherwise provided\n\nby law. The powers and duties of the Executive Director shall\n\ninclude, but not be limited to:\n\n1. Organize Service Oklahoma in a manner to efficiently achieve\n\nthe objectives of Service Oklahoma;\n\n2. Supervise all activities of Service Oklahoma;\n\n3. Administer programs and policies of Service Oklahoma;\n\n4. Employ, discharge, appoint, contract, and fix duties and\n\ncompensation of employees at the discretion of the Executive\n\nDirector;\n\n5. Appoint assistants, deputies, officers, investigators,\n\nattorneys, and other employees as may be necessary to carry out\n\nfunctions of Service Oklahoma;\n\n6. Prescribe rules and regulations for the operation of Service\n\nOklahoma;\n\n7. Provide input and recommendations to the Service Oklahoma\n\nOperator Board on all matters including branding and physical\n\nstandardization requirements, customer service metrics, analysis,\n\nand improvement processes for licensed operators, and processes for\n\ntermination of licensed operators for failure to comply with the\n\ncustomer service metrics;\n\n8. Establish internal policies and procedures;\n\n9. Prescribe and provide suitable forms deemed necessary to\n\ncarry out the functions of Service Oklahoma and any other laws the\n\nenforcement and administration of which are vested in Service\n\nOklahoma;\n\n10. Establish such divisions, sections, committees, advisory\n\ncommittees, offices, and positions in Service Oklahoma as the\n\nExecutive Director deems necessary to carry out the functions of\n\nService Oklahoma;\n\n11. Accept and disburse grants, allotments, gifts, devises,\n\nbequests, funds, appropriations, and other property made or offered\n\nto Service Oklahoma; and\n\n12. Create the budget for Service Oklahoma to be submitted to\n\nthe Legislature each year.\n\nC. The salary and other expenses for the Executive Director\n\nshall be budgeted as a separate line item through Service Oklahoma.\n\nThe operating expenses of Service Oklahoma shall be set by the\n\nExecutive Director and shall be budgeted as a separate line item\n\nthrough Service Oklahoma.\n\nD. 1. The Executive Director of Service Oklahoma shall direct\n\nall purchases, hiring, procurement, and budget for Service Oklahoma\n\nand establish, implement, and enforce policies and procedures\n\nrelated thereto, consistent with the Oklahoma Central Purchasing\n\nAct. Service Oklahoma and the Executive Director shall be subject\n\nto the requirements of the Public Competitive Bidding Act of 1974,\n\nthe Oklahoma Lighting Energy Conservation Act, and the Public\n\nFacilities Act.\n\n2. The Executive Director of Service Oklahoma, or any employee\n\nor agent of the Executive Director of Service Oklahoma acting within\n\nthe scope of delegated authority, shall have the same power and\n\nauthority related to purchases, hiring, procurement, and budget for\n\nService Oklahoma as outlined in paragraph 1 of this subsection for\n\nService Oklahoma as the State Purchasing Director has for all\n\nacquisitions used or consumed by state agencies as established in\n\nthe Oklahoma Central Purchasing Act. Such authority shall,\n\nconsistent with the authority granted to the State Purchasing\n\nDirector, include the power to designate financial or proprietary\nd budget for\n\nService Oklahoma as outlined in paragraph 1 of this subsection for\n\nService Oklahoma as the State Purchasing Director has for all\n\nacquisitions used or consumed by state agencies as established in\n\nthe Oklahoma Central Purchasing Act. Such authority shall,\n\nconsistent with the authority granted to the State Purchasing\n\nDirector, include the power to designate financial or proprietary\n\ninformation submitted by a bidder confidential and reject all\n\nrequests to disclose the information so designated, if the Executive\n\nDirector of Service Oklahoma requires the bidder to submit the\n\nfinancial or proprietary information with a bid, proposal, or\n\nquotation.\n\nE. Service Oklahoma shall determine the compensation to be\n\nretained by licensed operators.\n\n1. Before the last day in September in every even-numbered\n\nyear, Service Oklahoma shall review the compensation paid to\n\nlicensed operators and, if necessary, change the compensation.\n\nService Oklahoma shall engage an independent third party to evaluate\n\nthe compensation paid to licensed operators who shall provide any\n\nrecommendations no later than November 1 in the even-numbered year.\n\nAny recommended change in licensed operator compensation shall be\n\nfinalized by Service Oklahoma no later than the third Tuesday of\n\nNovember in the even-numbered year. Notice of such recommendation\n\nshall be provided to the Governor, the President Pro Tempore and the\n\nChair of the Appropriations Committee of the Senate, and the Speaker\n\nand the Chair of the Appropriations and Budget Committee of the\n\nHouse of Representatives.\n\n2. Any change in licensed operator compensation, unless\n\nrejected or amended as provided by this subsection, shall become\n\neffective on July 1 of the following calendar year.
