It shall be unlawful for any person to:\n\n1. Knowingly and intentionally destroy, remove, cover, alter or\n\ndeface, or cause to be destroyed, covered, removed, altered or\n\ndefaced the trim tag plate of a motor vehicle manufactured from 1953\n\nto 1977;\n\n2. Knowingly affix a counterfeit trim tag plate to a motor\n\nvehicle;\n\n3. Manufacture, offer for sale, sell, introduce, import or\n\ndeliver for sale or use in this state a counterfeit trim tag plate;\n\nor\n\n4. Offer for sale, sell, introduce, import or deliver for sale\n\nor use in this state a trim tag plate that was affixed to a motor\n\nvehicle at the time of manufacture but has since been removed or\n\nbecome dislodged.\n\nB. Paragraph 1 of subsection A of this section shall not apply\n\nto:\n\n1. Any person who engages in repair of a motor vehicle,\n\nprovided that removal of the vehicle's trim tag plate is reasonably\n\nnecessary for repair of a part of the vehicle to which the trim tag\n\nplate is affixed, and provided that such trim tag plate is not\n\nintentionally destroyed, altered or defaced; or\n\n2. Removal of a trim tag from a motor vehicle which is being\n\njunked or otherwise destroyed, if the removal is being done for\n\nhistorical documentation purposes by a person actively involved in\n\njudging events or for historical documentation of classic motor\n\nvehicles and reasonable precaution is taken to ensure that the tag\n\nis not sold or affixed to another motor vehicle.\n\nC. Any person convicted of violating the provisions of this act\n\nshall be guilty of a misdemeanor. Any person convicted of violating\n\nthe provisions of this act a second or subsequent time shall be\n\nguilty of a Class D1 felony offense and shall be punished as\n\nprovided for in subsections B through F of Section 20N of Title 21\n\nof the Oklahoma Statutes.\n\nD. In addition to any other civil remedy available, a person\n\ndefrauded as a result of a violation of this act may bring a civil\n\naction against any person who knowingly violated this act regardless\n\nof whether that person has been convicted of a violation of this\n\nact. A person defrauded as a result of a violation of this act may\n\nrecover treble their actual compensatory damages. In any action\n\nbrought pursuant to this subsection, the court may award reasonable\n\ncosts, including costs of expert witnesses, and attorney fees to the\n\nprevailing party.\n\nE. As used in this section:\n\n1. \"Trim tag plate\" means a plate or tag affixed to a motor\n\nvehicle by the manufacturer which displays numbers, symbols, or\n\ncodes that identify characteristics of the vehicle including, but\n\nnot limited to, date of manufacture, body style, paint color, engine\n\noption, transmission option, trim option, general option, interior\n\noption, and interior color;\n\n2. \"Counterfeit trim tag plate\" means:\n\na. any trim tag plate manufactured by a person or entity\n\nother than the original manufacturer of a motor\n\nvehicle upon which the trim tag plate is designed to\n\nbe affixed, unless the trim tag has been permanently\n\nstamped, in the same manner as other information on\n\nthe trim tag, with the words “REPLACEMENT TAG” in\n\nletters measuring at least one-eighth (1/8) of an inch\n\nin height, or\n\nb. any trim tag plate which has been altered from its\n\noriginal manufactured condition so as to change any of\n\nits numbers, symbols, or codes; and\n\n3. \"Motor vehicle\" means the same as defined in Section 1-134\n\nof this title.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2bb3dccab0a27a537b09a77e1c352b3806e33b78f71a7d429a85faccf3e4d66e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-4-107","next":"us-ok/okla.-stat.-tit.-47-47-4-108"},"notice":"GroundRules: Original legal text.
