Stat. tit. 47, § 47-427","heading":"Summons or notice of suit - Form - Service","body":"The original summons or notice of suit filed with the Secretary\n\nof the Commission, as provided in Section 6 hereof, in all actions\n\narising under the provisions of this act, shall be in form and\n\nsubstance the same as now provided in suits against residents of\n\nthis State, except that that part of said summons pertaining to the\n\nreturn day shall be in substantially the following form, to-wit:\n\n\"and unless you appear thereto and defend in the District Court\n\nof Oklahoma in and for ________ county at the Court House in\n\n________, Oklahoma, before noon of the sixtieth day following the\n\nfiling of this summons with the Secretary of the Oklahoma Tax\n\nCommission of this State, default will be entered and judgment\n\nrendered against you by the Court in the amount of $____, if said\n\nCourt is then in session in said county, and if the Court is not\n\nthen in session, said default will be entered and judgment rendered\n\nby the Court on the first day of the succeeding term, or as soon\n\nthereafter as the same may be reached.\"\n\nPlaintiff in any such action shall cause the original summons to\n\nbe served as follows:\n\n(a) By serving a copy of said original summons upon the\n\nSecretary of the Oklahoma Tax Commission, and\n\n(b) By mailing to the defendant and each of the defendants, if\n\nmore than one, within ten (10) days after the filing of said summons\n\nwith the Secretary of the Oklahoma Tax Commission by restricted\n\nregistered mail addressed to the defendant at his last-known\n\nresidence or place of abode a notification of said filing with the\n\nSecretary of the Oklahoma Tax Commission.\n\nThe notification provided for in this section shall be in\n\nsubstantially the following form, towit:\n\n\"To ________ (here insert the name of the defendant and his\n\nresidence or last known place of abode as definitely as known): You\n\nwill take notice that an original summons in a suit against you, a\n\ncopy of which is hereto attached, was duly served upon you at\n\nOklahoma City, Oklahoma, by filing copy of said summons on the\n\n________ day of ________, 19__, with the Secretary of the Oklahoma\n\nTax Commission of the State of Oklahoma. Dated at ________,\n\nOklahoma, this ________ day of ________, 19__.\n\n_________________\n\nPlaintiff\n\nBy _________________\n\nAttorney for Plaintiff\"\n\nThe term \"restricted registered mail\", as used herein, means\n\nmail which carries on the face thereof, in a conspicuous place where\n\nit will not be obliterated, the endorsement \"Deliver to addressee\n\nonly\", and which also requires a return receipt.\n\nProof of the filing of a copy of said summons with the\n\nSecretary of the Oklahoma Tax Commission and proof of the mailing of\n\nsaid notification to said itinerant merchant shall be made by\n\naffidavit by the party doing said acts. All affidavits of service\n\nshall be endorsed upon or attached to the originals of the papers to\n\nwhich they relate. All proofs of service, including the return\n\nregistry receipt, shall be forthwith filed with the clerk of the\n\ndistrict court in which said cause of action is pending.\n\nThe foregoing provisions relating to service of the original\n\nsummons on itinerant merchants shall not be deemed to prevent actual\n\npersonal service in this state upon such itinerant merchants in the\n\ntime, manner, form and under the conditions otherwise provided by\n\nlaw.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e60436fbe2cb2edaf15b1bbb88b138144482049f9ccb235c24ffcb73c31bc64a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-426","next":"us-ok/okla.-stat.-tit.-47-47-428"},"notice":"GroundRules: Original legal text.
