It shall be unlawful to be a broker.\n\nB. For the purposes of this section, \"broker\" means a person\n\nwho, for a fee, commission or other valuable consideration, arranges\n\nor offers to arrange a transaction involving the sale of a new motor\n\nvehicle or new powersports vehicle, and who is not:\n\n1. A new motor vehicle or new powersports vehicle dealer or\n\nemployee of such a dealer;\n\n2. A distributor or employee of such a distributor;\n\n3. A motor vehicle manufacturer or employee of such a\n\nmanufacturer; or\n\n4. An auctioneer or any other person engaged in the auto\n\nauction business.\n\nHowever, an individual shall not be deemed to be a broker if the\n\nindividual is the owner of the new or used motor vehicle or new or\n\nused powersports vehicle which is the object of the brokering\n\ntransaction.\n\nC. Any person convicted of being a broker as defined by this\n\nsection shall, upon conviction, be guilty of a misdemeanor\n\npunishable by imprisonment in the county jail for not more than one\n\n(1) year and a fine of not more than One Thousand Dollars\n\n($1,000.00).
