Prior to the purchase of a used motor vehicle, trailer, or\n\nnonmotorized recreational vehicle, the crusher shall require the\n\nfollowing proof of ownership from the person selling the used motor\n\nvehicle, trailer, or nonmotorized recreational vehicle:\n\n1. A certificate of title in the name of the seller that shows\n\nno outstanding liens;\n\n2. A notarized power of attorney from the individual on the\n\ncertificate of title authorizing the seller to dispose of the\n\nvehicle on behalf of the owner;\n\n3. A bill of sale from the owner as identified by the\n\ncertificate of title to the person presenting the vehicle to be\n\ncrushed or shredded;\n\n4. A statement of ownership from the seller stating that the\n\nvehicle to be crushed was purchased from the lawful owner,\n\naccompanied by a bill of sale from the lawful owner including a\n\nstatement that there are no outstanding liens on the vehicle, and a\n\nstatement that the vehicle is inoperable or incapable of operation\n\nor use on the highway and has no resale value except as scrap; or\n\n5. Paperwork from a licensed wrecker operator showing that the\n\nwrecker operator has properly foreclosed its lien on the used motor\n\nvehicle, trailer or nonmotorized recreational vehicle to be crushed\n\nor shredded, and that the person selling the vehicle is the owner of\n\nthe vehicle as shown on the return of sale in the foreclosure form.\n\nProvided, if the paperwork is subsequently proven to be fraudulent\n\nor falsified by the wrecker operator, the license of the wrecker\n\noperator may be suspended or revoked.\n\nB. A crusher shall not:\n\n1. Accept any vehicle to be crushed or shredded from a person\n\nunder the age of eighteen (18) years;\n\n2. Buy a vehicle from a person unable to supply verification of\n\nidentity by photo I.D. by either a state-issued identification card,\n\ndriver license or federal-government-issued identification card or\n\nby readable fingerprint of right or left index finger on the\n\npurchase document to be retained in the records of the crusher; or\n\n3. Crush or shred any vehicle purchased until making the report\n\nand waiting the time period required herein.\n\nC. A crusher shall:\n\n1. Make available a copy or report within three (3) days of any\n\npurchase of a vehicle to the local law enforcement agency of the\n\nmunicipality or other political subdivision in which the crusher is\n\nlocated or temporarily operating. Such copy or report shall be\n\nshown upon request to the representative of the Commission or to any\n\nauthorized peace officer;\n\n2. Hold the vehicle in the state and condition in which it was\n\npurchased for a period of three (3) days after submitting the report\n\nrequired in paragraph 1 of this subsection; and\n\n3. Include in the report:\n\na. the name, address and telephone number of the crusher\n\nwhereby the crusher may be immediately contacted,\n\nb. the name, address, race, sex, weight, height, date of\n\nbirth and identifying number of the seller as verified\n\nby either a state-issued identification card, driver\n\nlicense or federal-government-issued identification\n\ncard or by readable fingerprint of right or left index\n\nfinger on the purchase document to be retained in the\n\nrecords of the crusher, and\n\nc. a description of the vehicle, the manufacturer of the\n\nvehicle, the vehicle identification numbers of the\n\nvehicle, and the date and time of the purchase of the\n\nvehicle.\n\nD. A licensed automotive dismantler engaging the services of a\n\ncrusher shall not be required to produce proof of ownership to the\n\ncrusher before selling to the crusher vehicles or other property\n\npurchased by the automotive dismantler in the ordinary course of\n\nbusiness.\n\nE.
