Stat. tit. 47, § 47-596.1","heading":"Definitions","body":"As used in the Recreational Vehicle Franchise Act:\n\n1. “Area of sales responsibility” means a geographical area\n\nagreed to by a dealer and the manufacturer in a dealer agreement in\n\nwhich the dealer has the exclusive right to display or sell the new\n\nrecreational vehicles of a manufacturer of a particular line-make to\n\nthe public;\n\n2. “Camping trailer” means a vehicular unit that is mounted on\n\nwheels and constructed with collapsible partial side walls that fold\n\nfor towing by another vehicle and unfold at the campsite to provide\n\ntemporary living quarters for recreational, camping, or travel use;\n\n3. “Commission” means the Oklahoma New Motor Vehicle\n\nCommission;\n\n4. “Dealer” means any person, firm, corporation, or business\n\nentity licensed or required to be licensed pursuant to the\n\nprovisions of the Recreational Vehicle Franchise Act to sell new\n\nrecreational vehicles;\n\n5. “Dealer agreement” means a written agreement or contract\n\nentered into between a manufacturer and a dealer that establishes\n\nthe legal rights and obligations of the parties to that agreement or\n\ncontract and pursuant to which the dealer is authorized to sell new\n\nrecreational vehicles manufactured or distributed by the\n\nmanufacturer;\n\n6. “Established place of business” means a permanently enclosed\n\nbuilding or structure, easily accessible to the public, with a paved\n\nor graveled lot for customer parking and for the showing and storage\n\nof vehicles. Established place of business shall not mean tents,\n\ntemporary stands, lots, or other temporary quarters. The\n\nestablished place of business shall have a sign visible from the\n\noutside of the business which identifies the recreational vehicle\n\ndealership. The established place of business shall have an indoor\n\noffice with public areas sufficient to conduct sales transactions\n\nwith customers and have restroom facilities available for the\n\npublic. The established place of business shall include a service\n\nand parts area, separated from the public areas, equipped with\n\ntools, equipment, and replacement parts necessary for reasonably\n\nexpected warranty and service needs;\n\n7. “Factory campaign” means an effort by a warrantor to contact\n\nrecreational vehicle owners or recreational vehicle dealers in order\n\nto address an issue concerning a recreational vehicle problem,\n\ndefective part, or equipment;\n\n8. “Factory representative” means any officer or agent engaged\n\nas a representative of a manufacturer of recreational vehicles or a\n\nfactory branch for the purpose of making or promoting the sale of\n\nrecreational vehicles of the manufacturer or for supervising or\n\ncontacting dealers or prospective dealers of the manufacturer;\n\n9. “Family member” means any of the following:\n\na. a spouse of an individual,\n\nb. a child, grandchild, parent, sibling, niece, or nephew\n\nof an individual, or\n\nc. the spouse of a child, grandchild, parent, sibling,\n\nniece, or nephew of an individual;\n\n10. “Fifth wheel trailer” means a vehicular unit mounted on\n\nwheels that is designed to provide temporary living quarters for\n\nrecreational, camping, or travel use of such size and weight as to\n\nnot require a special highway movement permit and is designed to be\n\ntowed by a motorized vehicle that contains a towing mechanism that\n\nis mounted above or forward of the rear axle of the tow vehicle;\n\n11. “Line-make” means a specific series of recreational vehicle\n\nproducts that meet all of the following:\n\na. are identified by a common series trade name or\n\ntrademark,\n\nb. are targeted to a particular market segment based on\n\nthe decor, features, equipment, size, weight, and\n\nprice range,\n\nc. have dimensions and interior floor plans that\n\ndistinguish the recreational vehicles from\n\nrecreational vehicles that have substantially the same\n\ndecor, features, equipment, weight, and price,\n\nd. belong to a single, distinct classification of\ne 47. Motor Vehicles Page 927\n\nb. are targeted to a particular market segment based on\n\nthe decor, features, equipment, size, weight, and\n\nprice range,\n\nc. have dimensions and interior floor plans that\n\ndistinguish the recreational vehicles from\n\nrecreational vehicles that have substantially the same\n\ndecor, features, equipment, weight, and price,\n\nd. belong to a single, distinct classification of\n\nrecreational vehicle product type that has a\n\nsubstantial degree of commonality in the construction\n\nof the chassis, frame, and body, and\n\ne. are authorized for sale by the dealer in the dealer\n\nagreement;\n\n12. “Manufacturer” means a person that manufactures or\n\nwholesales recreational vehicles or that distributes or wholesales\n\nrecreational vehicles to dealers;\n\n13. “Motor home” means a motorized, vehicular unit designed to\n\nprovide temporary living quarters for recreational, camping, or\n\ntravel use;\n\n14. “Person” means an individual, partnership, corporation,\n\nlimited liability company, association, trust, estate, or other\n\nlegal entity;\n\n15. “Proprietary part” means a recreational vehicle part\n\nmanufactured by or for a manufacturer and sold exclusively by a\n\nmanufacturer;\n\n16. “Recreational vehicle” means a vehicle that:\n\na. is primarily designed as a vehicle that also provides\n\ntemporary living quarters for noncommercial,\n\nrecreational, or camping use,\n\nb. is built to the standards of the National Fire\n\nProtection Association for recreational vehicles,\n\nc. has its own motive power or is mounted on or towed by\n\nanother vehicle,\n\nd. is regulated by the National Highway Traffic Safety\n\nAdministration as a vehicle or vehicle equipment,\n\ne. does not require a special highway use permit for\n\noperation on the highways, and\n\nf. an individual can easily transport and set up on a\n\ndaily basis.\n\nRecreational vehicles include motor homes, travel trailers,\n\nfifth wheel travel trailers, folding camping trailers, and truck\n\ncampers;\n\n17. “Recreational vehicle salesperson” means any person who,\n\nfor gain or compensation of any kind, either directly or indirectly,\n\nregularly or occasionally, by any form of agreement or arrangement,\n\nsells or negotiates for the sale of any new recreational vehicle for\n\nany new recreational vehicle dealer to any one or more third\n\nparties;\n\n18. “Transient customer” means a person who:\n\na. owns a recreational vehicle,\n\nb. is temporarily traveling through the area of sales\n\nresponsibility of a dealer,\n\nc. engages the dealer to perform service work on that\n\nrecreational vehicle, and\n\nd. requires repairs that relate to the safe operations of\n\nthat recreational vehicle or, if not undertaken, are\n\nof a nature that would render that recreational\n\nvehicle unusable;\n\n19. “Travel trailer” means a vehicular unit mounted on wheels\n\nthat is designed to provide temporary living quarters for\n\nrecreational, camping, or travel use of such size and weight as to\n\nnot require a special highway movement permit when towed by a\n\nmotorized vehicle;\n\n20. “Truck camper” means a portable unit that is constructed to\n\nprovide temporary living quarters for recreational, camping, or\n\ntravel use and consists of a roof, floor, and sides and is designed\n\nto be loaded onto and unloaded from the back of a pickup truck; and\n\n21. “Warrantor” means a manufacturer or any other person that\n\nprovides a warranty to the consumer in connection with a new\n\nrecreational vehicle or parts, accessories, or components of a new\n\nrecreational vehicle.
