All of the following conditions shall apply to the area of\n\nsales responsibility of a dealer included in a dealer agreement\n\nbetween a manufacturer and a dealer:\n\n1. The manufacturer shall designate in the dealer agreement the\n\narea of sales responsibility exclusively assigned to the dealer;\n\n2. The manufacturer shall not change the area of sales\n\nresponsibility of a dealer or establish another dealer for the same\n\nline-make in that area during the term of the dealer agreement;\n\n3. The area of sales responsibility may not be reviewed or\n\nchanged without the consent of both parties until one (1) year after\n\nthe execution of the dealer agreement; and\n\n4. The areas within municipal, county, or state-owned or state-\n\ncontrolled facilities or within the grounds of any county, district,\n\nor state fair shall be exempt from manufacturer-designated areas of\n\nsales responsibility, only for the purposes of sponsored off-\n\npremises sales events.\n\nB. A dealer promoting its own private off-premises sales event,\n\nwherein that dealer is the sole participating dealer, shall not\n\nconduct sales activity or display for sale recreational vehicles\n\noutside of its manufacturer-designated area of sales responsibility.\n\nC. A dealer participating in a sponsored off-premises sales\n\nevent with other participating dealers may conduct sales activity or\n\ndisplay for sale recreational vehicles inside or outside the area of\n\nsales responsibility of the dealer.\n\n1. A sponsored recreational vehicle show may be held only under\n\nthe following conditions:\n\na. the sponsoring entity of the sales event shall obtain\n\na permit from the Oklahoma New Motor Vehicle\n\nCommission at the rate of Two Hundred Dollars\n\n($200.00) per event. The permit shall be for a period\n\nnot to exceed ten (10) consecutive days,\n\nb. dealer permits for a sponsored recreational vehicle\n\nshow described in this paragraph shall be obtained\n\nfrom the Commission at a rate of Fifteen Dollars\n\n($15.00) for each recreational vehicle at the show,\n\nc. a dealer participating in a sponsored off-premises\n\nsales show shall not be denied a permit on the grounds\n\nthat the promotion is to be held within the relevant\n\nmarket area of another dealer of the same-line make,\n\nd. new recreational vehicle dealers shall obtain written\n\napproval from the manufacturer or distributor to\n\nparticipate in the sponsored recreational vehicle\n\nshow, and\n\ne. the sponsored recreational vehicle show shall be\n\nconducted within municipal, county, or state-owned or\n\n-controlled facilities or within the grounds of any\n\ncounty, district, or state fair.\n\n2. A private recreational vehicle show where only one dealer\n\nmay sell recreational vehicles off-premises may be held under the\n\nfollowing conditions:\n\na. dealer permits for a private recreational vehicle show\n\ndescribed in this paragraph shall be obtained from the\n\nCommission at a rate of Fifteen Dollars ($15.00) for\n\neach recreational vehicle at the show,\n\nb. the location of the private recreational vehicle show\n\nshall be within the manufacturer-approved area of\n\nresponsibility,\n\nc. the private recreational vehicle show shall occur no\n\nmore than five (5) consecutive days per event,\n\nexcluding county, district, or state fairs,\n\nd. each dealer may participate in no more than eight\n\nprivate recreational vehicle shows per calendar year,\n\ne. private recreational vehicle shows, if held on\n\nprivately owned property, shall be no closer than two\n\nand one-half (2 1/2) miles to any other recreational\n\nvehicle dealer; provided, however, a private\n\nrecreational vehicle show may be held on county or\n\nmunicipally owned property with no mileage barrier\n\nrestriction,\n\nf. a dealer shall obtain written approval from the\n\nmanufacturer or distributor to participate in a\n\nprivate recreational vehicle show, and\n\ng. the sponsoring entity of the private sales event must\n1/2) miles to any other recreational\n\nvehicle dealer; provided, however, a private\n\nrecreational vehicle show may be held on county or\n\nmunicipally owned property with no mileage barrier\n\nrestriction,\n\nf. a dealer shall obtain written approval from the\n\nmanufacturer or distributor to participate in a\n\nprivate recreational vehicle show, and\n\ng. the sponsoring entity of the private sales event must\n\nprovide written permission for the dealer to conduct\n\nthe event on the sponsor’s property.\n\nD. A dealer may display a recreational vehicle within the\n\ndesignated area of responsibility of the dealer for promotional\n\npurposes. At an off-premises display event, no sales activities\n\nshall be conducted including, but not limited to, negotiations,\n\nfinancing, and accepting credit applications. Sales or finance\n\npersonnel shall not be permitted to participate at an off-premises\n\ndisplay event. A permit for the off-premises display event shall\n\nnot be required.\n\nE. A dealer agreement shall include a designated principal of\n\nthe dealer. A dealer agreement may identify a family member as the\n\nsuccessor of the principal or include a succession plan of the\n\ndealer.
