A warrantor has all of the following obligations to each\n\ndealer engaged in the sale or lease of products that are covered by\n\na warranty from that warrantor:\n\n1. To specify in writing to the dealer the obligations of the\n\ndealer, if any, for preparation, delivery, and warranty service on\n\nits products;\n\n2. To compensate the dealer for warranty service required of\n\nthe dealer by the warrantor;\n\n3. To provide the dealer with a schedule of compensation the\n\nwarrantor will pay for warranty work and the time allowances of the\n\nwarrantor for the performance of that work. All of the following\n\nconditions apply to the schedule of compensation required under this\n\nparagraph:\n\na. reasonable compensation for diagnostic work and\n\nwarranty labor,\n\nb. time allowances in the schedule for the diagnosis and\n\nperformance of warranty labor shall be reasonable for\n\nthe work to be performed, and\n\nc. the compensation of a dealer for warranty labor shall\n\nbe the actual retail labor rates charged by the dealer\n\nin the community in which the dealer is doing\n\nbusiness;\n\n4. To reimburse the dealer for warranty parts at actual\n\nwholesale cost, plus a minimum thirty percent (30%) handling charge\n\nand any freight costs to return warranty parts to the warrantor; and\n\n5. To deny dealer claims for warranty compensation only for\n\ncause, including, but not limited to, performance of nonwarranty\n\nrepairs, material noncompliance with the published policies and\n\nprocedures of the warrantor, lack of material documentation of\n\nclaims, fraud, or misrepresentation.\n\nB. A warrantor may conduct audits of the records of a dealer\n\nthat sells or leases its warranted products on a reasonable basis.\n\nC. A dealer shall submit warranty claims to a warrantor within\n\nsixty (60) days after completing all warranty work on a warranted\n\nproduct.\n\nD. A dealer shall notify the warrantor in writing if the dealer\n\nis unable to perform material or repetitive warranty repairs as soon\n\nas is reasonably possible.\n\nE. A warrantor shall approve or disapprove a warranty claim on\n\na warranted product in writing within thirty (30) days after the\n\ndate the dealer submits the claim, if the claim is submitted in the\n\nmanner and in the form prescribed by the warrantor.
