Stat. tit. 47, § 47-6-105v2","heading":"Graduated Class D licenses — Motorcycle-only licenses","body":"— Farm vehicle special permits.\n\nA. Unless a legal custodial parent or legal guardian has filed\n\nan objection to licensure pursuant to Section 6-103.1 of this title,\n\nany person under eighteen (18) years of age may be permitted to\n\noperate:\n\n1. A Class D motor vehicle under the graduated driver license\n\nprovisions prescribed in subsections B through E of this section;\n\n2. A motorcycle under the provisions prescribed in subsection H\n\nof this section; or\n\n3. A farm vehicle under the provisions prescribed in subsection\n\nI of this section.\n\nB. Any person who is at least fifteen (15) years of age may\n\ndrive during a session in which the driver is being instructed in a\n\ndriver education course, as set out in subparagraphs a, b, c, d and\n\ne of paragraph 1 of subsection C of this section, by a certified\n\ndriver education instructor who is seated in the right front seat of\n\nthe motor vehicle.\n\nC. Any person:\n\n1. Who is at least fifteen and one-half (15 1/2) years of age\n\nand is currently receiving instruction in or has successfully\n\ncompleted driver education. For purposes of this section, the term\n\n“driver education” shall mean:\n\na. a prescribed secondary school driver education course,\n\nas provided for in Sections 19-113 through 19-121 of\n\nTitle 70 of the Oklahoma Statutes,\n\nb. a driver education course, certified by Service\n\nOklahoma, from a parochial, private, or other\n\nnonpublic secondary school,\n\nc. a commercial driver training course, as defined by\n\nSections 801 through 808 of this title,\n\nd. a parent-taught driver education course, certified by\n\nService Oklahoma, in conjunction with the Department\n\nof Public Safety. Service Oklahoma shall promulgate\n\nrules for any parent-taught driver education course,\n\nor\n\ne. a driver education course certified by a state other\n\nthan Oklahoma; or\n\n2. Who is at least sixteen (16) years of age,\n\nmay, upon successfully passing all parts of the driver license\n\nexamination administered by Service Oklahoma, or an approved written\n\nexamination proctor, except the driving examination, be issued a\n\nlearner permit which will grant the permittee the privilege to\n\noperate a Class D motor vehicle upon the public highways only\n\nbetween the hours of 5:00 a.m. and 10:00 p.m. and while accompanied\n\nby a licensed driver who is at least twenty-one (21) years of age\n\nand who is actually occupying a seat beside the permittee; provided,\n\nthe written examination for a learner permit may be waived by\n\nService Oklahoma upon verification that the person has successfully\n\ncompleted driver education.\n\nD. 1. Any person:\n\na. who has applied for, been issued, and has possessed a\n\nlearner permit for a minimum of one hundred eighty\n\n(180) days,\n\nb. whose custodial legal parent or legal guardian\n\ncertifies to Service Oklahoma by sworn affidavit that\n\nthe person has received a minimum of fifty (50) hours\n\nof actual behind-the-wheel training, of which at least\n\nten (10) hours of such training was at night, from a\n\nlicensed driver who was at least twenty-one (21) years\n\nof age and who was properly licensed to operate a\n\nClass D motor vehicle for a minimum of two (2) years,\n\nand\n\nc. who has completed a free course approved by the\n\nOklahoma Department of Transportation on teen driver\n\nwork zone and first responder safety,\n\nmay be issued an intermediate Class D license upon successfully\n\npassing all parts of the driver license examinations administered by\n\nService Oklahoma; provided, the written examination, if it has not\n\npreviously been administered or waived, may be waived by Service\n\nOklahoma upon verification that the person has successfully\n\ncompleted driver education or the driving examination may be waived\n\nby Service Oklahoma upon successful passage of the examination\n\nadministered by a certified designated examiner, as provided for in\n\nSection 6-110 of this title. However, notwithstanding the date of\nnot\n\npreviously been administered or waived, may be waived by Service\n\nOklahoma upon verification that the person has successfully\n\ncompleted driver education or the driving examination may be waived\n\nby Service Oklahoma upon successful passage of the examination\n\nadministered by a certified designated examiner, as provided for in\n\nSection 6-110 of this title. However, notwithstanding the date of\n\nissuance of the learner permit, if the person has been convicted of\n\na traffic offense which is reported on the driving record of that\n\nperson, the time period specified in subparagraph a of this\n\nparagraph shall be recalculated to begin from the date of conviction\n\nfor the traffic offense, and must elapse before that person may be\n\nissued an intermediate Class D license. If the person has been\n\nconvicted of more than one traffic offense which is reported on the\n\ndriving record of that person, the time period specified in\n\nsubparagraph a of this paragraph shall be recalculated to begin from\n\nthe most recent date of conviction, and must elapse before that\n\nperson may be issued an intermediate Class D license.\n\n2. A person who has been issued an intermediate Class D license\n\nunder the provisions of this subsection:\n\na. shall be granted the privilege to operate a Class D\n\nmotor vehicle upon the public highways:\n\n(1) only between the hours of 5:00 a.m. and 10:00\n\np.m., except for driving to and from work,\n\nschool, school activities, and church activities,\n\nor\n\n(2) at any time, if a licensed driver who is at least\n\ntwenty-one (21) years of age is actually\n\noccupying a seat beside the intermediate Class D\n\nlicensee, or if the intermediate Class D licensee\n\nis a farm or ranch resident, and is operating a\n\nmotor vehicle while engaged in farming or\n\nranching operations outside the limits of a\n\nmunicipality, or driving to and from work,\n\nschool, school activities, or church activities,\n\nand\n\nb. shall not operate a motor vehicle with more than one\n\npassenger unless:\n\n(1) all passengers live in the same household as the\n\ncustodial legal parent or legal guardian, or\n\n(2) a licensed driver at least twenty-one (21) years\n\nof age is actually occupying a seat beside the\n\nintermediate Class D licensee.\n\nE. Any person who has been issued an intermediate Class D\n\nlicense for a minimum of:\n\n1. One (1) year; or\n\n2. One hundred eighty (180) days, if the person has completed\n\nboth the driver education and the parent-certified behind-the-wheel\n\ntraining provisions of subparagraph b of paragraph 1 of subsection D\n\nof this section,\n\nmay be issued a Class D license. However, notwithstanding the date\n\nof issuance of the Class D license, if the person has been convicted\n\nof a traffic offense which is reported on the driving record of that\n\nperson, the time periods specified in paragraph 1 or 2 of this\n\nsubsection, as applicable, shall be recalculated to begin from the\n\ndate of conviction for the traffic offense, and must elapse before\n\nthat person may be issued a Class D license. If the person has been\n\nconvicted of more than one traffic offense which is reported on the\n\ndriving record of that person, the time periods specified in\n\nparagraph 1 or 2 of this subsection, as applicable, shall be\n\nrecalculated to begin from the most recent date of conviction, and\n\nmust elapse before that person may be issued a Class D license.\n\nF. Learner permits and intermediate Class D licenses shall be\n\nissued for the same period as all other driver licenses. The\n\nlicenses may be suspended or canceled at the discretion of the\n\nDepartment, with notice to Service Oklahoma for violation of\n\nrestrictions, for failing to give the required or correct\n\ninformation on the application, for knowingly giving false or\n\ninaccurate information on the application or any subsequent\n\ndocumentation related to the granting of driving privileges, for\n\nusing a hand-held electronic device while operating a motor vehicle\nhe discretion of the\n\nDepartment, with notice to Service Oklahoma for violation of\n\nrestrictions, for failing to give the required or correct\n\ninformation on the application, for knowingly giving false or\n\ninaccurate information on the application or any subsequent\n\ndocumentation related to the granting of driving privileges, for\n\nusing a hand-held electronic device while operating a motor vehicle\n\nfor non-life-threatening emergency purposes or for violation of any\n\ntraffic laws of this state pertaining to the operation of a motor\n\nvehicle.\n\nG. Service Oklahoma shall promulgate rules establishing\n\nprocedures for removal of learner permit and intermediate Class D\n\nlicense restrictions from the permit or license upon the permittee\n\nor licensee qualifying for a less restricted or an unrestricted\n\nlicense.\n\nH. Any person fourteen (14) years of age or older may apply for\n\na restricted Class D license with a motorcycle-only restriction.\n\nAfter the person has successfully passed all parts of the motorcycle\n\nexamination other than the driving examination, has successfully\n\ncompleted a certified state-approved motorcycle basic rider course\n\napproved by the Department of Public Safety, in conjunction with\n\nService Oklahoma, and has met all requirements provided for in the\n\nrules of the Department and Service Oklahoma, Service Oklahoma shall\n\nissue to the person a restricted Class D license with a motorcycle-\n\nonly restriction which shall grant to the person, while having the\n\nlicense in the person’s immediate possession, the privilege to\n\noperate a motorcycle or motor-driven cycle:\n\n1. With a piston displacement not to exceed three hundred cubic\n\ncentimeters (300 cc) or a sixteen and eight-tenths (16.8) kilowatt\n\nelectric power source;\n\n2. Between the hours of 4:30 a.m. to 9:00 p.m. only;\n\n3. While wearing approved protective headgear; and\n\n4. While accompanied by and receiving instruction from any\n\nperson who is at least twenty-one (21) years of age and who is\n\nproperly licensed pursuant to the laws of this state to operate a\n\nmotorcycle or motor-driven cycle, and who has visual contact with\n\nthe restricted licensee.\n\nThe restricted licensee may apply on or after thirty (30) days\n\nfrom date of issuance of the restricted Class D license with a\n\nmotorcycle-only restriction to have the restriction of being\n\naccompanied by a licensed driver removed by successfully completing\n\nthe driving portion of an examination.\n\nThe written examination and driving examination for a restricted\n\nClass D license with a motorcycle-only endorsement shall be waived\n\nby Service Oklahoma upon verification that the person has\n\nsuccessfully completed a certified state-approved motorcycle basic\n\nrider course approved by the Department and Service Oklahoma.\n\nI. 1. Any person who is less than seventeen (17) years of age\n\nbut is at least fourteen (14) years of age and who resides upon a\n\nfarm in this state or is employed for compensation upon a farm in\n\nthis state may apply to Service Oklahoma for a farm permit\n\nauthorizing such person, while possessing the permit, to operate any\n\nClass D motor vehicle.\n\n2. a. A farm permit shall entitle the licensee, who is at\n\nleast fourteen (14) years of age but less than sixteen\n\n(16) years of age, to operate the appropriate motor\n\nvehicles at any time:\n\n(1) while going to or from or in connection with any\n\nfarm job, employment, or other farm-related work,\n\n(2) on days while school is in session, over the most\n\ndirect and accessible route between the\n\nlicensee’s residence and school of enrollment for\n\nthe purpose of school attendance; provided, that\n\nthe privilege shall only extend to those\n\nlicensees who reside on a farm and commute\n\ndirectly from their place of residence to the\n\nschool in which they are enrolled, or\nnt, or other farm-related work,\n\n(2) on days while school is in session, over the most\n\ndirect and accessible route between the\n\nlicensee’s residence and school of enrollment for\n\nthe purpose of school attendance; provided, that\n\nthe privilege shall only extend to those\n\nlicensees who reside on a farm and commute\n\ndirectly from their place of residence to the\n\nschool in which they are enrolled, or\n\n(3) when the licensee is operating a passenger car at\n\nany time when accompanied by an adult who is the\n\nholder of a valid commercial driver license,\n\nClass A, B, C, or D driver license and who is\n\nactually occupying a seat beside the driver.\n\nb. For a period of six (6) months, a farm permit shall\n\nentitle the licensee who is at least sixteen (16)\n\nyears of age to operate the appropriate motor vehicles\n\nat any time:\n\n(1) from 5:00 a.m. to 9:00 p.m.,\n\n(2) while going to or from or in connection with any\n\nfarm job, employment, or other farm-related work,\n\n(3) while going to or from authorized school\n\nactivities,\n\n(4) while going directly to or from any religious\n\nworship service held by a religious organization,\n\nor\n\n(5) while the licensee is operating a passenger car\n\nat any time while accompanied by an adult who is\n\nthe holder of a valid commercial driver license,\n\nClass A, B, or C driver license, and who is\n\nactually occupying a seat beside the driver.\n\nAfter such six-month period, if the licensee has complied with the\n\nprovisions of this subsection, such farm permit shall entitle the\n\nlicensee to operate the appropriate motor vehicles at any time\n\nwithout the restrictions required by this subsection.\n\n3. A farm permit shall be issued only if:\n\na. the applicant can prove that such applicant resides or\n\nworks on a farm by submitting the signed affidavit of\n\neither a parent or guardian stating that the applicant\n\nlives on a farm,\n\nb. the applicant has successfully completed the\n\nexamination requirements in Section 6-110 of this\n\ntitle, and\n\nc. the applicant does not live on a farm but works on a\n\nfarm and the applicant submits the signed affidavit of\n\nthe applicant’s employer and parent or guardian\n\nattesting to such employment.\n\n4. Any licensee issued a farm permit under this subsection:\n\na. who is less than sixteen (16) years of age shall not\n\noperate any motor vehicle with nonsibling minor\n\npassengers,\n\nb. who is at least sixteen (16) years of age, for a\n\nperiod of six (6) months after reaching sixteen (16)\n\nyears of age, shall not operate any motor vehicle with\n\nmore than one passenger who is less than eighteen (18)\n\nyears of age and who is not a member of the licensee’s\n\nimmediate family, or\n\nc. who is at least fourteen (14) years of age, but less\n\nthan sixteen (16) years of age, shall not operate any\n\nmotor vehicle on interstate or turnpike highway\n\nsystems, nor shall a licensee operate a motor vehicle\n\nwithin the limits of a city with a population in\n\nexcess of one hundred thousand (100,000) persons\n\naccording to the latest Federal Decennial Census.\n\nAny conviction for violating this paragraph shall be construed as a\n\nmoving traffic violation. Service Oklahoma may, in its discretion,\n\nsuspend the permit of an individual for violation of this paragraph.\n\n5. Any licensee issued a farm permit under this subsection\n\nshall not operate a wireless communication device while driving a\n\nmotor vehicle, except that a licensee may operate a wireless\n\ncommunication device while driving a motor vehicle to report illegal\n\nactivity or to summon medical or other emergency help.\n\n6. As used in this subsection, “farm” means any parcel of land\n\nfor which the owner has an agricultural exemption permit issued by\n\nthe Oklahoma Tax Commission.\n\n7. a. A farm permit issued under this subsection is subject\n\nto suspension or revocation in the same manner as any\n\nother driver license.\n\nb. A farm permit may be suspended in accordance with\nor to summon medical or other emergency help.\n\n6. As used in this subsection, “farm” means any parcel of land\n\nfor which the owner has an agricultural exemption permit issued by\n\nthe Oklahoma Tax Commission.\n\n7. a. A farm permit issued under this subsection is subject\n\nto suspension or revocation in the same manner as any\n\nother driver license.\n\nb. A farm permit may be suspended in accordance with\n\nSection 6-113 of this title for any violation of\n\nrestrictions under this subsection.\n\nc. Service Oklahoma shall suspend the farm permit upon\n\nreceiving satisfactory evidence that the licensee has\n\nbeen involved in two or more accidents chargeable to\n\nthe licensee and such suspended license shall not be\n\nreinstated for one (1) year.\n\n8. Any licensee issued a farm permit under this subsection\n\nshall provide, prior to reaching sixteen (16) years of age, a signed\n\naffidavit of either a parent or guardian stating that the applicant\n\nhas completed at least fifty (50) hours of adult-supervised driving\n\nwith at least ten (10) of those hours being at night. The adult-\n\nsupervised driving required by this paragraph shall be conducted by\n\nan adult who is at least twenty-one (21) years of age and is the\n\nholder of a valid commercial driver license, Class A, B, C, or D\n\ndriver license. Evidence of failure of any licensee who was\n\nrequired to complete the fifty (50) hours of adult-supervised\n\ndriving under this subsection shall not be admissible in any action\n\nfor the purpose of determining any aspect of comparative negligence\n\nor mitigation of damages.\n\n9. Any licensee issued a farm permit under this subsection who:\n\na. is under sixteen (16) years of age and is convicted of\n\ntwo or more moving traffic violations committed on\n\nseparate occasions shall not be eligible to receive a\n\ndriver license which is not restricted, in accordance\n\nwith the provisions of subparagraph a of paragraph 2\n\nof this subsection, until the person reaches seventeen\n\n(17) years of age,\n\nb. is at least sixteen (16) years of age but less than\n\nseventeen (17) years of age and is convicted of two or\n\nmore moving traffic violations committed on separate\n\noccasions shall not be eligible to receive a driver\n\nlicense which is not restricted, in accordance with\n\nthe provisions of subparagraph b of paragraph 2 of\n\nthis subsection, until the person reaches eighteen\n\n(18) years of age, or\n\nc. fails to provide the affidavit required under\n\nparagraph 8 of this subsection shall not be eligible\n\nto receive a driver license which is not restricted,\n\nin accordance with the provisions of subparagraph a of\n\nparagraph 2 of this subsection, until the person\n\nprovides such affidavit to Service Oklahoma or the\n\nperson reaches seventeen (17) years of age, whichever\n\noccurs first.\n\nJ. As used in this section:\n\n1. “Hand-held electronic device” means a mobile telephone or\n\nelectronic device with which a user engages in a telephone call,\n\nplays or stores media, including but not limited to music and video,\n\nor sends or reads a text message while requiring the use of at least\n\none hand; and\n\n2. “Using a hand-held electronic device” means engaging any\n\nfunction on an electronic device.\n\nK.
