Stat. tit. 47, § 47-6-107","heading":"Restricted licenses for unemancipated persons under 18 -","body":"Signature of legal parent or guardian - Liability - Financial\n\nresponsibility - Cancellation or suspension.\n\nA. In addition to the requirements of Section 6-106 of this\n\ntitle, the application of any unemancipated person under the age of\n\neighteen (18) years for a restricted license shall be signed and\n\nverified by the legal custodial parent or legal guardian of the\n\napplicant, either in person before a person authorized to administer\n\noaths, electronically if completing an online application, or by a\n\nnotarized affidavit signed by a custodial legal parent or legal\n\nguardian and submitted with the application by the person under the\n\nage of eighteen (18) years before a person authorized to administer\n\noaths. The signature of the legal custodial parent or legal\n\nguardian shall be evidence that the legal custodial parent or legal\n\nguardian is willing to assume the obligation imposed under Section\n\n1-101 et seq. of this title upon a person signing the application of\n\na person under the age of eighteen (18) years. Provided, however,\n\nany unemancipated person under the age of eighteen (18) years who is\n\nin the permanent custody of the Department of Human Services, upon\n\nproof of financial responsibility in respect to the operation of a\n\nmotor vehicle owned by him or her or if not the owner of a motor\n\nvehicle then with respect to the operation of any motor vehicle, in\n\nform and in amounts as required under the motor vehicle financial\n\nresponsibility laws of this state, shall not be required to have his\n\nor her application for restricted license signed or verified by\n\nanother person.\n\nB. Any negligence or willful misconduct of a person under the\n\nage of eighteen (18) years when driving a motor vehicle upon a\n\nhighway with the knowledge and consent of the person who signed the\n\napplication or notarized affidavit for the restricted license shall\n\nbe imputed to the person who has signed the application or notarized\n\naffidavit. Such person shall be jointly and severally liable with\n\nthe minor for any damages caused by such negligence or willful\n\nmisconduct, except as otherwise provided in subsection C of this\n\nsection.\n\nC. In the event a person under the age of eighteen (18) years\n\ndeposits, or there is deposited upon his or her behalf, proof of\n\nfinancial responsibility in respect to the operation of a motor\n\nvehicle owned by him or her or if not the owner of a motor vehicle\n\nthen with respect to the operation of any motor vehicle, in form and\n\nin amounts as required under the motor vehicle financial\n\nresponsibility laws of this state, then Service Oklahoma may accept\n\nthe application of such person when signed by the legal custodial\n\nparent or the legal guardian of such person, and while such proof is\n\nmaintained the legal custodial parent or legal guardian shall not be\n\nsubject to the liability imposed under subsection B of this section.\n\nD. Service Oklahoma may, at its discretion, cancel or suspend\n\nthe license of any person under the age of eighteen (18) years for\n\nany unlawful act, negligence or misconduct while driving a motor\n\nvehicle.\n\nE. As provided in Section 6-103.1 of this title, any legal\n\ncustodial parent or legal guardian who has signed the application or\n\nnotarized affidavit of a person under the age of eighteen (18) years\n\nfor a license may thereafter file with Service Oklahoma a verified\n\nwritten request that the license of that person so granted be\n\ncanceled. Service Oklahoma shall then cancel the license of the\n\nperson and the legal custodial parent or legal guardian who signed\n\nthe application or notarized affidavit of the person shall be\n\nrelieved from the liability imposed under Section 1-101 et seq. of\n\nthis title by reason of having signed the application on account of\n\nany subsequent negligence or willful misconduct of the person in\n\noperating a motor vehicle.\na shall then cancel the license of the\n\nperson and the legal custodial parent or legal guardian who signed\n\nthe application or notarized affidavit of the person shall be\n\nrelieved from the liability imposed under Section 1-101 et seq. of\n\nthis title by reason of having signed the application on account of\n\nany subsequent negligence or willful misconduct of the person in\n\noperating a motor vehicle.\n\nF. Service Oklahoma upon receipt of satisfactory evidence of\n\nthe death of the legal custodial parent or legal guardian who signed\n\nthe application or notarized affidavit of a person under the age of\n\neighteen (18) years for a license shall cancel the license and shall\n\nnot issue a new license until such time as a new application, duly\n\nsigned and verified, is made as required by this chapter.
