Service Oklahoma shall implement a procedure for\n\ncomputerized finger imaging by means of an inkless finger image\n\nscanning device and shall require every applicant for an original,\n\nrenewal, or replacement driver license or identification card to\n\nsubmit to finger imaging for the purposes of proof of identity and\n\nto ensure the security of the driver license or identification card\n\nissued to the applicant. If the finger image of a person over\n\nsixty-five (65) years of age cannot be scanned and the issuing agent\n\ncan personally verify the individual’s identity with alternative\n\nidentification, the finger imaging shall be overridden. Means must\n\nbe provided to trace to the agent who authorized the override.\n\nB. No unemancipated person under eighteen (18) years of age\n\nshall be issued a driver license or identification card by Service\n\nOklahoma unless an authorization form, prescribed and furnished by\n\nService Oklahoma, or notarized affidavit authorizing the finger\n\nimaging of the person and signed by the legal custodial parent,\n\nlegal guardian, or legal custodian of the person, is in the\n\npossession of Service Oklahoma.\n\nC. No law enforcement agency of the state or federal government\n\nother than the Department of Public Safety shall have access to any\n\ninformation collected through the use of computerized finger imaging\n\nwithout first obtaining a court order from a judge of competent\n\njurisdiction; provided, however, the Oklahoma State Bureau of\n\nInvestigation shall have access to such imaging for the purpose of\n\nidentifying a person who is deceased, missing, or endangered. Each\n\napplication for an order authorizing the access to any information\n\ncollected through the use of computerized finger imaging shall be\n\nmade in writing upon oath or affirmation to a judge of competent\n\njurisdiction. Each application shall establish probable cause for\n\nbelief that a named individual is committing, has committed, or is\n\nabout to commit a particular violation of law.\n\nD.
