Stat. tit. 47, § 47-6-110.3","heading":"Prohibition of implementation of federal REAL ID Act -","body":"Legislative findings - Retrieval and deletion of biometric data.\n\nA. The Legislature finds that the enactment into law by the\n\nUnited States Congress of the federal REAL ID Act of 2005, Public\n\nLaw Number 109-13, is an action that individual Oklahomans should\n\nhave an option to refuse under the principles of federalism\n\ncontained in the Tenth Amendment to the United States Constitution.\n\nB. The State of Oklahoma shall offer its citizens the option of\n\nchoosing a Compliant Driver License or Identification Card or a\n\nNoncompliant Driver License or Identification Card.\n\nC. In carrying out the provisions of this Act, the State of\n\nOklahoma shall not share with the federal government any personal\n\ninformation or biometric data obtained from an applicant for an\n\nOklahoma REAL ID compliant or noncompliant driver license or\n\nidentification card except as required by the REAL ID Act of 2005,\n\nPublic Law Number 109-13. Provided, this subsection shall not\n\nprevent the sharing of such information between agencies, boards,\n\ncommissions or political subdivisions of this state or as otherwise\n\npermitted by law.\n\nD. For purposes of this section, \"biometric data\" includes, but\n\nis not limited to:\n\n1. Facial feature pattern characteristics;\n\n2. Voice data used for comparing live speech with a previously\n\ncreated speech model of a person's voice;\n\n3. Iris recognition data containing color or texture patterns\n\nor codes;\n\n4. Retinal scans, reading through the pupil to measure blood\n\nvessels lining the retina;\n\n5. Behavior characteristics of a handwritten signature, such as\n\nshape, speed, pressure, pen angle, or sequence;\n\n6. Fingerprints, palm prints, and other methods for measuring\n\nor recording ridge pattern or fingertip characteristics;\n\n7. Keystroke dynamics, measuring pressure applied to key pads;\n\n8. Hand geometry, measuring hand characteristics, including the\n\nshape and length of fingers, in three (3) dimensions; and\n\n9.
