Stat. tit. 47, § 47-6-110.4","heading":"Pilot program for certified third-party examiners for","body":"commercial truck driver instructors.\n\nA. The Department of Public Safety is directed to develop and\n\nimplement a pilot program to evaluate the potential use of certified\n\ncommercial truck driver training instructors employed by businesses\n\nengaged in interstate or intrastate commerce licensed in the state\n\nof Oklahoma to be certified third-party examiners for the Department\n\nof Public Safety. The pilot program shall have a maximum of ten\n\nbusinesses and shall begin no later than July 1, 2016, for a period\n\nof two (2) years.\n\nB. Any certified commercial truck driver training instructor\n\nwho is currently an operator or an employee of a business engaged in\n\ninterstate or intrastate commerce licensed in this state shall be\n\neligible to apply to be a third-party tester of the Department of\n\nPublic Safety for the purpose of administering the Class A, B or C\n\ndriving skills portion of the Oklahoma driving examination to any\n\nperson who has not previously been a student of the instructor.\n\nC. No business shall be established for the education and\n\ntraining of persons, and no person shall act as an instructor or\n\nthird-party tester unless such business or person applies for and\n\nobtains from the Commissioner of Public Safety a license in the\n\nmanner and form prescribed by the Commissioner.\n\nD. The Department of Public Safety shall adopt a curriculum of\n\nrequired courses and training to be offered to applicants who are\n\nqualified to apply to be a third-party tester. The courses and\n\ntraining for certification shall meet the same standards as required\n\nfor commercial driver examiners of the Department of Public Safety.\n\nE. Each business engaged in interstate or intrastate commerce\n\nlicensed in this state with an employee or person applying to be an\n\ninstructor or third-party tester shall be required to pay an initial\n\nfee of Five Thousand Dollars ($5,000.00) and an annual renewal fee\n\nof Five Thousand Dollars ($5,000.00). Each person applying to be an\n\ninstructor or third-party tester shall be required to pay an initial\n\ncertification fee of Two Thousand Five Hundred Dollars ($2,500.00).\n\nUpon successful completion of training prescribed by subsection D of\n\nthis section, the person shall be required to pay an annual third-\n\nparty tester certification fee of Two Thousand Five Hundred Dollars\n\n($2,500.00). The third-party tester certification fees collected by\n\nthe Department pursuant to this subsection shall be deposited to the\n\ncredit of the Department of Public Safety Restricted Revolving Fund\n\nto be used for the purposes of this section. The Department shall\n\nnot be required to operate this program unless adequate funds are\n\nprovided. No third-party tester certification fee shall be refunded\n\nto the business or person in the event that certification is denied,\n\nsuspended or revoked.\n\nF. The Department shall conduct on an annual basis a complete\n\nnationwide criminal history background check on each third-party\n\ntester and a complete nationwide criminal history background check\n\non each third-party tester applicant. The fees for the background\n\ncheck shall be borne by the third-party tester or third-party tester\n\napplicant.\n\nG. The Department of Public Safety shall promulgate rules to\n\nimplement and administer the provisions of this section based on\n\nrequirements set forth in Section 383.75 of Title 47 of the Code of\n\nFederal Regulations.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"40c96785cc494f356744cf1f0404ae19ed31b72c4e9d22867bb8121eef2656c4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-6-110.3","next":"us-ok/okla.-stat.-tit.-47-47-6-110.5"},"notice":"GroundRules: Original legal text.
