Service Oklahoma shall file every application for a driver\n\nlicense or identification card received by Service Oklahoma and\n\nshall maintain suitable indexes containing:\n\n1. All applications denied and on each thereof note the reasons\n\nfor the denial;\n\n2. All applications granted;\n\n3. The name of every person whose driving privilege has been\n\nsuspended, revoked, canceled, or disqualified by Service Oklahoma\n\nand after each such name note the reasons for the action. Any\n\nnotation of suspension of the driving privilege of a person for\n\nreason of nonpayment of a fine shall be removed from the driving\n\nrecord after the person has paid the fine and the driving privilege\n\nof the person is reinstated as provided for by law;\n\n4. The county of residence, the name, date of birth, and\n\nmailing address of each person residing in that county who is\n\neighteen (18) years of age or older, and who is the holder of a\n\ncurrent driver license or a current identification card issued by\n\nService Oklahoma for the purpose of ascertaining names of all\n\npersons qualified for jury service as required by Section 18 of\n\nTitle 38 of the Oklahoma Statutes; and\n\n5. The name, driver license number, and mailing address of\n\nevery person for the purpose of giving notice, if necessary, as\n\nrequired by Section 2-116 of this title.\n\nB. Service Oklahoma shall file all collision reports and\n\nabstracts of court records of convictions received by it pursuant to\n\nthe laws of this state and maintain convenient records of the\n\nrecords and reports or make suitable notations in order that an\n\nindividual record of a person showing the convictions of the person\n\nand the traffic collisions in which the person has been involved\n\nshall be readily ascertainable and available for the consideration\n\nof Service Oklahoma upon any application for a driver license or\n\nrenewal of a driver license and at other suitable times. Any\n\nabstract, index or other entry relating to a driving record\n\naccording to the licensing authority in another state or a province\n\nof Canada may be posted upon the driving record of any resident of\n\nthis state when notice thereof is received by documentation or by\n\nelectronic transmission. The individual record of a person shall\n\nnot include any collision reports and abstracts of court records\n\ninvolving a collision in which the person was not issued a citation\n\nor if a citation is issued and the person was not convicted.\n\nC. 1. Service Oklahoma may designate and is hereby authorized\n\nto prepare under the seal of Service Oklahoma and deliver upon\n\nrequest a copy of any collision report on file with the Department\n\nof Public Safety, charging a fee of:\n\na. beginning on July 1, 2011, through June 30, 2013,\n\nFifteen Dollars ($15.00), of which Eight Dollars\n\n($8.00) shall be deposited by the Commissioner of\n\nPublic Safety to the credit of the Department of\n\nPublic Safety Revolving Fund and, in addition to other\n\npurposes authorized by law, the expenditures from that\n\nfund of monies derived from the Eight Dollars ($8.00)\n\npursuant to this subparagraph shall be used to fund\n\nany Oklahoma Highway Patrol academy provided by the\n\nDepartment of Public Safety. Any remaining funds\n\nshall be deposited in an account to be utilized\n\nexclusively for future expenses directly related to\n\nthe operation of an Oklahoma Highway Patrol academy,\n\nand\n\nb. beginning on July 1, 2013, and any year thereafter,\n\nSeven Dollars ($7.00).\n\nHowever, Service Oklahoma shall not be required to furnish\n\npersonal information from the collision report which is contrary to\n\nthe provisions of the Driver’s Privacy Protection Act, 18 U.S.C.,\n\nSections 2721 through 2725.\n\n2. Notwithstanding the provisions of paragraph 1 of this\n\nsubsection, Service Oklahoma is authorized to enter into contracts\n\nto supply information regarding vehicles reported to be involved in\n\ncollisions. For each vehicle, the information shall be limited to\nthe collision report which is contrary to\n\nthe provisions of the Driver’s Privacy Protection Act, 18 U.S.C.,\n\nSections 2721 through 2725.\n\n2. Notwithstanding the provisions of paragraph 1 of this\n\nsubsection, Service Oklahoma is authorized to enter into contracts\n\nto supply information regarding vehicles reported to be involved in\n\ncollisions. For each vehicle, the information shall be limited to\n\nthat which only describes the vehicle and the collision. Service\n\nOklahoma shall not be required to provide any information regarding\n\nthe owner or operator of the vehicle or any information which would\n\nconflict with Section 2-110 or Section 1109 of this title.\n\nD. Service Oklahoma or any licensed operator upon request shall\n\nprepare and furnish to any authorized person a Motor Vehicle Report\n\nof any person subject to the provisions of the motor vehicle laws of\n\nthis state. However, Service Oklahoma shall not be required to\n\nfurnish personal information from a driving record contrary to the\n\nprovisions of the Driver’s Privacy Protection Act of 1994, 18\n\nU.S.C., Sections 2721 through 2725. The Motor Vehicle Report shall\n\nbe a summary of the driving record of the person and shall include\n\nthe enumeration of any motor vehicle collisions, reference to\n\nconvictions for violations of motor vehicle laws, and any action\n\ntaken against the privilege of the person to operate a motor\n\nvehicle, as shown by the files of Service Oklahoma for the three (3)\n\nyears preceding the date of the request. The Motor Vehicle Report,\n\nto include any record or information associated with the Motor\n\nVehicle Report, shall not be deemed a public civil record as\n\nprovided in Section 18 of Title 22 of the Oklahoma Statutes, and\n\nshall not be subject to expungement. Service Oklahoma shall not be\n\nrequired to release to any person, in whole or in part and in any\n\nformat, a driving index, as described in subsection A of this\n\nsection, except as otherwise provided for by law. For each Motor\n\nVehicle Report furnished by Service Oklahoma, Service Oklahoma shall\n\ncollect the sum of Twenty-five Dollars ($25.00), Twenty Dollars\n\n($20.00) of which shall be deposited in the General Revenue Fund and\n\nFive Dollars ($5.00) shall be deposited in the Department of Public\n\nSafety Revolving Fund through October 31, 2022. Beginning November\n\n1, 2022, the Five Dollars ($5.00) shall be deposited in the Service\n\nOklahoma Revolving Fund. For each Motor Vehicle Report furnished by\n\na licensed operator, the licensed operator shall collect the sum of\n\nTwenty-five Dollars ($25.00), Eighteen Dollars ($18.00) of which\n\nshall be paid to the Oklahoma Tax Commission for deposit in the\n\nGeneral Revenue Fund of the State Treasury, Five Dollars ($5.00)\n\nshall be deposited in the Department of Public Safety Revolving Fund\n\nand Two Dollars ($2.00) of which shall be retained by the licensed\n\noperator through October 31, 2022. Beginning November 1, 2022, for\n\neach Motor Vehicle Report furnished by a licensed operator, the\n\nlicensed operator shall collect the sum of Twenty-five Dollars\n\n($25.00), Eighteen Dollars ($18.00) of which shall be paid to\n\nService Oklahoma for deposit in the General Revenue Fund of the\n\nState Treasury, Five Dollars ($5.00) shall be deposited in the\n\nService Oklahoma Revolving Fund, and Two Dollars ($2.00) shall be\n\nretained by the licensed operator through June 30, 2025. Beginning\n\nJuly 1, 2025, Eighteen Dollars ($18.00) of the fee shall be paid to\n\nService Oklahoma for deposit in the General Revenue Fund of the\n\nState Treasury, Five Dollars ($5.00) shall be deposited in the\n\nService Oklahoma Revolving Fund, and Two Dollars ($2.00) shall be\n\nretained by the licensed operator pursuant to subsection E of\n\nSection 1141.1 of this title. Persons sixty-five (65) years of age\n\nor older shall not be required to pay a fee for their own Motor\n\nVehicle Report furnished by Service Oklahoma or a licensed operator.\nthe\n\nState Treasury, Five Dollars ($5.00) shall be deposited in the\n\nService Oklahoma Revolving Fund, and Two Dollars ($2.00) shall be\n\nretained by the licensed operator pursuant to subsection E of\n\nSection 1141.1 of this title. Persons sixty-five (65) years of age\n\nor older shall not be required to pay a fee for their own Motor\n\nVehicle Report furnished by Service Oklahoma or a licensed operator.\n\nFor purposes of this subsection, a Motor Vehicle Report shall\n\ninclude a report which indicates that no driving record is on file\n\nwith Service Oklahoma for the information received by Service\n\nOklahoma in the request for the Motor Vehicle Report.\n\nE. Service Oklahoma may develop procedures whereby an acting\n\nagent of an employer or an employer of a person:\n\n1. Who has a Class A, B, C or D driver license; and\n\n2. Who operates a commercial, company-owned or personal motor\n\nvehicle during the course of business in the course of his or her\n\nemployment with the employer, may automatically be notified,\n\npursuant to a fee schedule established by Service Oklahoma, should\n\nthe driving record of a person reflect a traffic conviction in any\n\ncourt or an administrative action by Service Oklahoma which alters\n\nthe status of the commercial driving privileges of the person, or\n\nany other change to the driving status. The notification system\n\nshall include electronic delivery of a Motor Vehicle Report at least\n\nannually for any employee who is a commercial driver licensee or who\n\noperates a commercial motor vehicle, as required by 49 C.F.R.,\n\nSection 391.25, or who operates a company-owned or personal motor\n\nvehicle during the course of business. All monies received by the\n\nCommissioner of Public Safety and the officers and employees of the\n\nDepartment pursuant to this subsection shall be deposited in the\n\nDepartment of Public Safety Restricted Revolving Fund through\n\nOctober 31, 2022. Beginning November 1, 2022, all monies received\n\nby the Director of Service Oklahoma and the officers and employees\n\nof Service Oklahoma pursuant to this subsection shall be deposited\n\nin the Service Oklahoma Revolving Fund. For each Motor Vehicle\n\nReport furnished by Service Oklahoma, through the electronic\n\nnotification system, Service Oklahoma shall collect the sum of\n\nTwenty-five Dollars ($25.00), Eighteen Dollars ($18.00) of which\n\nshall be deposited in the General Revenue Fund of the State\n\nTreasury. Five Dollars ($5.00) shall be deposited in the Department\n\nof Public Safety Revolving Fund through October 31, 2022. Beginning\n\nNovember 1, 2022, for each Motor Vehicle Report furnished by Service\n\nOklahoma, through the electronic notification system, Service\n\nOklahoma shall collect the sum of Twenty-five Dollars ($25.00),\n\nEighteen Dollars ($18.00) of which shall be deposited in the General\n\nRevenue Fund of the State Treasury, and Five Dollars ($5.00) shall\n\nbe deposited in the Service Oklahoma Revolving Fund. Two Dollars\n\n($2.00) shall be retained by Service Oklahoma or its authorized\n\nagent for the purpose of development and maintenance of the\n\nelectronic notification system.\n\nF. Service Oklahoma is authorized to establish a procedure for\n\nreviewing the driving records of state residents who are existing\n\npolicyholders of any insurance company licensed to operate in this\n\nstate during specified periods of time and producing a report which\n\nidentifies the policyholders which have had violation and/or status\n\nchanges to their driving records during such time period. Service\n\nOklahoma may sell such report to the insurance company or its agent\n\nat a fee to be set by Service Oklahoma. Any such report sold by\n\nService Oklahoma shall only consist of information otherwise\n\nlawfully obtainable by the insurance company or its agent. The fee\n\nshall be sufficient to recover all costs incurred by Service\n\nOklahoma and ensure that there will be no net revenue loss to the\nService\n\nOklahoma may sell such report to the insurance company or its agent\n\nat a fee to be set by Service Oklahoma. Any such report sold by\n\nService Oklahoma shall only consist of information otherwise\n\nlawfully obtainable by the insurance company or its agent. The fee\n\nshall be sufficient to recover all costs incurred by Service\n\nOklahoma and ensure that there will be no net revenue loss to the\n\nstate. Such fee shall be deposited in the Department of Public\n\nSafety Revolving Fund through October 31, 2022. Beginning November\n\n1, 2022, such fee shall be deposited in the Service Oklahoma\n\nRevolving Fund.\n\nG.
