There is hereby created a Driver License Medical Advisory\n\nCommittee whose membership shall be composed of two members\n\nappointed by the State Commissioner of Health, two members appointed\n\nby the Commissioner of Public Safety, one member appointed by the\n\nGovernor, one member appointed by the President Pro Tempore of the\n\nSenate, and one member appointed by the Speaker of the House of\n\nRepresentatives. One member appointed by the State Commissioner of\n\nHealth, one member appointed by the Commissioner of Public Safety\n\nand the member appointed by the Governor shall each serve two (2)\n\nyears and one member appointed by the State Commissioner of Health,\n\none member appointed by the Commissioner of Public Safety, the\n\nmember appointed by the President Pro Tempore of the Senate and the\n\nmember appointed by the Speaker of the House of Representatives\n\nshall each serve three (3) years. The terms of the seven (7)\n\nmembers of the committee shall expire on the first day of January of\n\nthe year in which the term of each member expires. The personnel of\n\nthe Board shall include, but not be limited to, an internist, vision\n\nspecialist, orthopedic surgeon, neurologist, and psychiatrist.\n\nMembers of the Committee shall serve in the interest of public\n\nhealth, safety and welfare, without compensation for their services.\n\nThe Committee shall meet from time to time as its duties may\n\nrequire, or when called by the Commissioner of Public Safety. The\n\nCommissioner is authorized to use appropriated funds for meal\n\nexpenses related to such meetings. The Committee may use additional\n\nmedical doctors, psychologists or medical support specialists and\n\ndelegate the authority to act and recommend action on behalf of the\n\nCommittee when such delegation is approved by the Commissioner of\n\nPublic Safety.\n\nB. The Committee shall recommend standards for determining the\n\nphysical, emotional and mental capacity of applicants for driver\n\nlicenses and holders of driver licenses, and submit the recommended\n\nstandards to Service Oklahoma for adoption. Service Oklahoma shall\n\nalso solicit input on the recommended standards from select medical\n\nprofessional organizations including, but not limited to, the\n\nAmerican Diabetes Association and the American Heart Association\n\nbefore adopting such standards. In cases of ailment or disability\n\nnot specifically covered by the adopted standards, the Committee may\n\nconsider each case or delegate consideration of the case to its\n\nselected representative and may consider the individual's own\n\ncompensating abilities in making its recommendations to Service\n\nOklahoma.\n\nC. Service Oklahoma shall give due consideration to the\n\nfindings and recommendations of the Committee, which may be used,\n\ntogether with other available information, in determining the\n\napplicant's or licensee's ability to operate a motor vehicle with a\n\nreasonable degree of safety and in accordance with established\n\nstandards of Service Oklahoma. Service Oklahoma may require\n\nphysical, psychological, vision, written or driving tests when\n\nnecessary to make a determination pursuant to this section. Such\n\nfindings and recommendations shall be considered with other evidence\n\nin determining whether the license should be canceled or denied.\n\nD. Any person whose driver license is canceled or who is denied\n\na driver license under the provisions of this section shall have the\n\nright to an appeal as provided for in Section 6-211 of this title.\n\nThe findings and recommendations of the Committee or its selected\n\nrepresentative, in written or oral form shall be admissible as\n\nevidence and shall be considered by the court in determining whether\n\nthe action of Service Oklahoma was justified.\n\nE. Members of the Driver License Medical Advisory Committee or\n\nits selected representative shall not be held liable for their\n\nrequested standards, opinions and recommendations presented in good\nmittee or its selected\n\nrepresentative, in written or oral form shall be admissible as\n\nevidence and shall be considered by the court in determining whether\n\nthe action of Service Oklahoma was justified.\n\nE.
