Service Oklahoma shall permit a driver license or state\n\nidentification cardholder to voluntarily designate that the person\n\nhas been diagnosed with an autism spectrum disorder by a licensed\n\nprimary care physician, licensed psychologist, or licensed\n\npsychiatrist. The designation shall be used by a law enforcement\n\nofficer or an emergency medical professional to identify and\n\neffectively communicate with a person who has been diagnosed with an\n\nautism spectrum disorder and shall not be used for any other purpose\n\nby any other person.\n\n2. The cardholder may choose whether the voluntary designation\n\nindicating that a person has been diagnosed with an autism spectrum\n\ndisorder pursuant to paragraph 1 of this subsection shall be\n\ndisplayed on the driver license or identification card or in the\n\nOklahoma Law Enforcement Telecommunications System (OLETS) in\n\naccordance with procedures prescribed by Service Oklahoma. A holder\n\nof a driver license or identification card who makes a voluntary\n\ndesignation pursuant to this section shall have the opportunity to\n\nremove the designation at any time.\n\nB. 1. Service Oklahoma shall establish and maintain an\n\nautomated statewide registry accessible by law enforcement officers\n\nfor the purpose of identifying and effectively communicating with a\n\nperson who has been diagnosed with an autism spectrum disorder by a\n\nlicensed primary care physician, licensed psychologist, or licensed\n\npsychiatrist. Service Oklahoma shall permit a person diagnosed with\n\nan autism spectrum disorder to voluntarily report the diagnosis to\n\nService Oklahoma for inclusion in the registry. The registry shall\n\nbe capable of storing information, which shall include, but not be\n\nlimited to:\n\na. the license plate and registration information of any\n\nmotor vehicle that the person intends to regularly\n\noperate,\n\nb. the emergency contact information of a person who can\n\ncommunicate on behalf of the person who has been\n\ndiagnosed with an autism spectrum disorder, and\n\nc. any other information that may assist a law\n\nenforcement officer when communicating with the\n\nperson.\n\n2. Service Oklahoma shall develop a standardized autism\n\ndiagnosis form that provides a diagnosing or treating licensed\n\nprimary care physician, licensed psychologist, or licensed\n\npsychiatrist to certify that an individual has been diagnosed with\n\nan autism spectrum disorder. The holder of an Oklahoma driver\n\nlicense or identification card or a person making application or\n\nrenewal for a driver license or identification card issued by\n\nService Oklahoma may voluntarily submit the form to the registry\n\nestablished pursuant to paragraph 1 of this subsection, through\n\nprocedures established by Service Oklahoma. A holder of a driver\n\nlicense or identification card who submits information to the\n\nregistry shall have the opportunity to revise, update the\n\ninformation, or be removed from the registry at any time.\n\n3. Information submitted pursuant to this section shall only be\n\navailable to Service Oklahoma, licensed operators who are designated\n\nto collect and maintain the information, and law enforcement\n\nofficers when accessing the person's motor vehicle records. The\n\ninformation shall be exclusively used during a motor vehicle stop or\n\nother law enforcement action to assist law enforcement officers in\n\nidentifying and effectively communicating with a person who has been\n\ndiagnosed with an autism spectrum disorder.\n\n4. Any information submitted to Service Oklahoma or licensed\n\noperators pursuant to this section shall not be considered a\n\ngovernment record pursuant to subparagraph c of paragraph 1 of\n\nSection 24A.5 of Title 51 of the Oklahoma Statutes and shall not be\n\ndiscoverable as a government record by any person, entity, or\n\ngovernmental agency, except upon a subpoena issued by a grand jury\n\nor a court order in a criminal matter.\ned to Service Oklahoma or licensed\n\noperators pursuant to this section shall not be considered a\n\ngovernment record pursuant to subparagraph c of paragraph 1 of\n\nSection 24A.5 of Title 51 of the Oklahoma Statutes and shall not be\n\ndiscoverable as a government record by any person, entity, or\n\ngovernmental agency, except upon a subpoena issued by a grand jury\n\nor a court order in a criminal matter.\n\n5. Service Oklahoma, its employees, or licensed operators, for\n\nthe purpose of discharging their duties pursuant to this act, shall\n\nnot be liable to any person for civil damages or subject to criminal\n\nprosecution resulting from or caused by:\n\na. any disruption or failure in Internet service caused\n\nby any accident, malfunction, act of sabotage or\n\nnature, or any other condition or circumstance that\n\nService Oklahoma has not, directly or indirectly,\n\ncaused, and which prevents the holder of an Oklahoma\n\ndriver license or identification card from accessing\n\nor inputting information into the registry established\n\npursuant to this subsection, or which results in, or\n\nprevents, Service Oklahoma, licensed operators,\n\ndesignated Service Oklahoma employees, and law\n\nenforcement officers from accessing, establishing, or\n\nmaintaining the database,\n\nb. any misuse of, or the failure or omission to input\n\naccurate information, or the inputting of inaccurate\n\nor outdated information into the registry by any\n\nholder of an Oklahoma driver license or identification\n\ncard, or\n\nc. the inability of any law enforcement officer to make\n\ncontact, in good faith, with any designated emergency\n\ncontact person. This limitation of liability is\n\ninapplicable if such failure resulted from a malicious\n\npurpose or a wanton and willful disregard for the\n\nsafety of persons or property.\n\n6. With regard to the issuance of REAL-ID compliant licenses\n\ncontaining designations pursuant to this section, Service Oklahoma\n\nshall comply with all federal design requirements and shall seek\n\ndesign approval from all necessary federal agencies, including, but\n\nnot limited to, the United States Department of Homeland Security.\n\n7.
