A driver improvement or defensive driving course is a course\n\nwhich offers an educational setting and provides for driving\n\nconcepts which encourage attitude or behavioral changes in the\n\nresponsibility of operating a motor vehicle in a safe and\n\nresponsible manner.\n\nB. It shall be the responsibility of the institution or\n\norganization to provide:\n\n1. Adequate facilities which meet or exceed state and local\n\nfire, health and safety codes;\n\n2. Adequate equipment, in good working order, and instructional\n\nmaterials for such courses;\n\n3. Qualified instructors who shall:\n\na. possess an undergraduate degree, have possessed an\n\ninstructor’s license pursuant to Section 804 of this\n\ntitle for at least five (5) years, or be a peace\n\nofficer certified by the Council on Law Enforcement\n\nEducation and Training (CLEET),\n\nb. have no alcohol or drug-related convictions or\n\nrevocations in the past five (5) years,\n\nc. have no more than five (5) points accumulated on the\n\ndriving record in the past three (3) years in\n\naccordance with the Oklahoma Mandatory Point System,\n\nd. have a valid Oklahoma driver license, and\n\ne. complete a course of training through the approved\n\norganization or institution;\n\n4. A course of study designed to inform the participant of\n\ndriver improvement and defensive driving concepts while encouraging\n\nattitude or behavioral changes in the responsibility of operating a\n\nmotor vehicle in a safe and responsible manner. The curriculum,\n\nwhich means the complete lesson plans which include instructional\n\nstrategy, presentation methods and resources utilized to incorporate\n\nthe concepts of traffic safety, must provide for but not be limited\n\nto the following:\n\na. driver personality traits - behavioral attitudes,\n\nb. driver qualifications and limitations,\n\nc. effects of alcohol and other drugs, and\n\nd. current accident prevention and defensive driving\n\ntechniques: speed control, perception, reactions,\n\nlane positioning, safe turning and passing, occupant\n\nrestraints, following distance and rules of the road;\n\nand\n\n5. Provide at least four (4) hours of classroom instruction.\n\nC. Organizations or institutions desirous of making application\n\nshall submit the following to the Department of Public Safety:\n\n1. Evidence of organizational or institutional status which\n\nmeet statutory requirements;\n\n2. Copy of proposed course curriculum which includes lesson\n\nobjectives, presentation materials, instructional strategy and\n\nresources utilized;\n\n3. Certification that instructors meet statutory requirements;\n\nand\n\n4. Upon Department of Public Safety approval, the organization\n\nor institution shall be considered for point credits as set forth in\n\nthis section.\n\nD. The Department of Public Safety is authorized to grant a\n\ntwo-point credit towards the Oklahoma Point System Regulations to\n\nany person who successfully completes a course pursuant to this\n\nsection provided only one such course shall be acknowledged once\n\nevery twenty-four (24) months.\n\nE. The Department, upon giving of notice and hearing, may\n\ndecline to grant credit points to any organization or institution\n\nfor:\n\n1. Unethical conduct of an instructor or official of an\n\ninstitution or organization;\n\n2. Failure to satisfactorily resolve citizens’ complaints;\n\n3. Falsifying or misrepresenting any document or information to\n\nthe Department or student;\n\n4. Failure of an organization or instructor to meet statutory\n\nrequirements;\n\n5. Conflict of interest by the organization or institution\n\nand/or its personnel; or\n\n6. Failure of an organization, institution or instructor to\n\ncontinue to meet statutory requirements as provided for in this\n\nsection.\n\nF. Course enrollment shall be limited to not more than thirty\n\nstudents.\n\nG. Enrollment in the course shall not be limited to persons\n\nordered to enroll, attend and successfully complete the course.\n\nH. The organization or institution shall within fifteen (15)\nor\n\n6. Failure of an organization, institution or instructor to\n\ncontinue to meet statutory requirements as provided for in this\n\nsection.\n\nF. Course enrollment shall be limited to not more than thirty\n\nstudents.\n\nG. Enrollment in the course shall not be limited to persons\n\nordered to enroll, attend and successfully complete the course.\n\nH. The organization or institution shall within fifteen (15)\n\ndays of the completion certify to the Department of Public Safety\n\nall persons who successfully complete the course on a form approved\n\nor furnished by the Department. This shall include the person’s\n\nfull name, address, date of birth and driver license number.\n\nI. Department personnel shall be admitted to any course without\n\ncharge, upon request and display of proper credentials.\n\nJ. Each organization or institution shall develop auditing\n\nprocedures which could be utilized to show compliance with this\n\nsection.\n\nK.
