Stat. tit. 47, § 47-6-212","heading":"Reinstatement fees - Conditions for reinstatement -","body":"Provisional license.\n\nA. Service Oklahoma shall not assess and collect multiple\n\nreinstatement fees when reinstating the driving privilege of any\n\nperson having more than one suspension or revocation affecting the\n\nperson’s driving privilege at the time of reinstatement.\n\nB. Service Oklahoma shall:\n\n1. Suspend or revoke a person’s driving privilege as delineated\n\nwithin the Oklahoma Statutes; and\n\n2. Require any person having more than one suspension or\n\nrevocation affecting the person’s driving privilege to meet the\n\nstatutory requirements for each action as a condition precedent to\n\nthe reinstatement of any driving privilege. Provided, however,\n\nreinstatement fees shall not be cumulative, and a single\n\nreinstatement fee, as provided for in subsection C of this section,\n\nshall be paid for all suspensions or revocations as shown by Service\n\nOklahoma’s records at the time of reinstatement.\n\nC. Whenever a person’s privilege to operate a motor vehicle is\n\nsuspended or revoked pursuant to any provision as authorized by the\n\nOklahoma Statutes, the license or privilege to operate a motor\n\nvehicle shall remain under suspension or revocation and shall not be\n\nreinstated until:\n\n1. The expiration of each such revocation or suspension order;\n\n2. The person has paid to Service Oklahoma:\n\na. if such privilege is suspended or revoked pursuant to\n\nSection 1115.5 of Title 22 of the Oklahoma Statutes or\n\npursuant to any provisions of this title, except as\n\nprovided in subparagraph b of this paragraph, a\n\nprocessing fee of Twenty-five Dollars ($25.00) for\n\neach such suspension or revocation as shown by Service\n\nOklahoma’s records, or\n\nb. (1) if such privilege is suspended or revoked\n\npursuant to the provisions of Section 6-205, 6-\n\n205.1, 7-612, 753, 754 or 761 of this title or\n\npursuant to subsection A of Section 7-605 of this\n\ntitle for a conviction for failure to maintain\n\nthe mandatory motor vehicle insurance required by\n\nlaw or pursuant to subsection B of Section 6-206\n\nof this title for a suspension other than for\n\npoints accumulation, a processing fee of Seventy-\n\nfive Dollars ($75.00) for each such suspension or\n\nrevocation as shown by Service Oklahoma’s\n\nrecords, and a special assessment trauma-care fee\n\nof Two Hundred Dollars ($200.00) to be deposited\n\ninto the Trauma Care Assistance Revolving Fund\n\ncreated in Section 1-2530.9 of Title 63 of the\n\nOklahoma Statutes, for each suspension or\n\nrevocation as shown by the records of Service\n\nOklahoma, and\n\n(2) in addition to any other fees required by this\n\nsection, if such privilege is suspended or\n\nrevoked pursuant to an arrest under the\n\nprovisions of paragraph 2 or 6 of subsection A of\n\nSection 6-205 of this title or of Section 753,\n\n754 or 761 of this title, a fee of Fifteen\n\nDollars ($15.00), which shall be apportioned\n\npursuant to the provisions of Section 3-460 of\n\nTitle 43A of the Oklahoma Statutes; and\n\n3. The person has paid to Service Oklahoma a single\n\nreinstatement fee of Twenty-five Dollars ($25.00).\n\nService Oklahoma shall notify the license holder within three (3)\n\ndays of reinstatement that the license holder shall apply for a new\n\ndriver license pursuant to subsection A of Section 6-209 of this\n\ntitle.\n\nD. Service Oklahoma shall enter into agreements with persons\n\nwhose license to operate a motor vehicle or commercial motor vehicle\n\nhas been suspended or revoked, for issuance of a provisional license\n\nsubject to any restrictions imposed by law or a court order. The\n\nprovisional license would allow such persons to drive from 6:00 a.m.\n\nto 11:59 p.m. Driving privileges for a provisional license are\n\nlimited from 12:00 a.m. to 5:59 a.m. to driving:\n\n1. Between their place of residence and their place of\n\nemployment or potential employment;\n\n2. During the scope and course of their employment;\n\n3. Between their place of residence and a college, university\n\nor technology center;\ncense would allow such persons to drive from 6:00 a.m.\n\nto 11:59 p.m. Driving privileges for a provisional license are\n\nlimited from 12:00 a.m. to 5:59 a.m. to driving:\n\n1. Between their place of residence and their place of\n\nemployment or potential employment;\n\n2. During the scope and course of their employment;\n\n3. Between their place of residence and a college, university\n\nor technology center;\n\n4. Between their place of residence and their child’s school or\n\nday care provider;\n\n5. Between their place of residence and a place of worship; or\n\n6. Between their place of residence and any court-ordered\n\ntreatment program,\n\nwith the condition that such persons pay a minimum total of Five\n\nDollars ($5.00) per month toward the satisfaction of outstanding\n\nfees, including, but not limited to, provisional license fees,\n\nwarrant fees, court costs or fees, driver license or commercial\n\ndriver license reinstatement fees. Service Oklahoma may suspend or\n\nrevoke a provisional license pursuant to this section if the person\n\nfails to honor the payment plan. The person may re-enroll in the\n\nprovisional driver license program.\n\nE. Any person convicted of an offense specified in paragraph 1,\n\n4, or 8 of subsection A of Section 6-205 of this title shall not be\n\neligible for a provisional license.\n\nF. Any violation of law by the person holding the provisional\n\nlicense that would result in the suspension or revocation of a\n\ndriver license, except for the failure to pay fines, fees, or other\n\nfinancial obligations if the person is participating in a payment\n\nplan, shall result in the revocation of the provisional license.\n\nG. Eligibility for a provisional license shall not take into\n\nconsideration any outstanding fines and fees owed, including, but\n\nnot limited to, warrant fees, court costs or fees, driver license or\n\ncommercial driver license reinstatement fees.\n\nH. A person with a suspended driver license shall not have to\n\ntake a driver license test to be eligible for a provisional license,\n\nprovided the suspended license has not expired.\n\nI. The Department of Corrections shall provide inmates with\n\nrelevant documentation to obtain a provisional license as provided\n\nin subsection D of this section before being released from custody.\n\nThe Department of Corrections shall develop rules and procedures\n\nnecessary to implement the provisions of this subsection.\n\nJ. Service Oklahoma shall develop rules and procedures\n\nnecessary to implement the provisions of this section except as\n\notherwise provided by this title.\n\nK. For each fiscal year:\n\n1. Two Hundred Fifty Thousand Dollars ($250,000.00) of all\n\nmonies collected each month pursuant to this section shall be\n\napportioned as provided in Section 1104 of this title, except as\n\notherwise provided in this section; and\n\n2.
