The Department of Public Safety shall upon request consent\n\nto the immediate cancellation of any certificate of insurance or the\n\nDepartment shall direct and the State Treasurer shall return to the\n\nperson entitled thereto any money or securities deposited pursuant\n\nto this article or Article II of this chapter as proof of financial\n\nresponsibility, or the Department shall waive the requirement of\n\nfiling proof of financial responsibility, in any of the following\n\nevents:\n\n1. In the event of the death of the person on whose behalf the\n\nproof of financial responsibility was filed or the permanent\n\nincapacity of the person to operate a motor vehicle; or\n\n2. In the event the person who has given proof of financial\n\nresponsibility surrenders his or her driver license to the\n\nDepartment.\n\nB. Provided, however, that the Department shall not consent to\n\nthe cancellation of any certificate of insurance and the Department\n\nshall not consent to the return of any money or securities in the\n\nevent any action for damages upon a liability covered by such proof\n\nof financial responsibility is then pending or any judgment upon any\n\nsuch liability is then unsatisfied, or in the event the person who\n\nhas filed such bond or deposited such money or securities has within\n\none (1) year immediately preceding such request been involved as a\n\ndriver or owner in any accident resulting in injury or damage to the\n\nperson or property of others.
