In order to furnish a means of relief from extreme and\n\nunusually severe hardship in the application of Article II or\n\nArticle III of this chapter, it is hereby provided that any owner or\n\noperator whose driving privilege has been suspended by the\n\nDepartment of Public Safety under the provisions of Article II or\n\nArticle III of this chapter for failure to furnish security or for\n\nfailure to satisfy a judgment may make application for modification\n\nof the order of suspension to the district court of the county where\n\nsuch owner or operator resides.\n\nThe application shall contain the following:\n\n1. The name and address of the applicant;\n\n2. The date and location of the accident, names of any fatality\n\nor fatalities, names of persons injured, and/or names of persons\n\nwhose real or personal property was damaged in the accident;\n\n3. A statement that the applicant has failed to comply with the\n\nprovisions of Article II or Article III of this chapter by either\n\nfailing to post security or to satisfy a judgment;\n\n4. The facts creating the unusual or severe hardship impairing\n\nthe ability of the applicant to earn a livelihood;\n\n5. That the applicant has initiated action to post proof of\n\nfinancial responsibility by a method enumerated in Section 7-320 of\n\nthis title;\n\n6. A true copy of the order of suspension attached thereto; and\n\n7. A verification by the applicant.\n\nB. The district court shall set the application for hearing not\n\nless than fifteen (15) days nor more than thirty (30) days from the\n\ndate of filing the application.\n\nC. A certified copy of the application, bond, order for hearing\n\nand any other pleadings shall be served upon the Department of\n\nPublic Safety, all judgment creditors and/or persons on whose behalf\n\nsecurity has been required or by mailing a copy to their last known\n\naddress at least ten (10) days before the hearing.\n\nD. Persons required to be notified of the hearing may appear\n\nand resist the application of Article II or Article III of this\n\nchapter. At the hearing the court shall take testimony concerning\n\nthe hardship of the applicant, testimony of any interested party,\n\nand allow the driving record and accident record of the applicant to\n\nbe introduced into evidence by the Department of Public Safety.\n\nAfter hearing on the application, but not before, if the court finds\n\nthat the suspension has resulted or will result in extreme and\n\nunusually severe hardship, seriously impairing the ability of the\n\napplicant to earn a livelihood, the court may modify, but not\n\nvacate, the order of suspension and the extent to which the\n\napplicant shall comply with the provisions of Articles II and III of\n\nthis chapter with respect to furnishing security or satisfying a\n\njudgment. If the court finds the order of suspension should be\n\nmodified, then the court shall require that the applicant furnish\n\nproof of financial responsibility by a method enumerated in Section\n\n7-320 of this title. The proof of financial responsibility shall be\n\nfurnished to the Department of Public Safety. The modification\n\nshall not become effective until the proof of financial\n\nresponsibility is furnished to the Department together with a\n\ncertified order of the court setting forth the modification.\n\nE. An appeal may be taken by any interested party from the\n\norder of the district court to the Supreme Court of the State of\n\nOklahoma.\n\nF.
