The Department of Public Safety shall transfer to the\n\nOklahoma Insurance Department by January 1, 2018, the online\n\nverification system for motor vehicle liability policies as required\n\nby the Compulsory Insurance Law, subject to the following:\n\n1. The Oklahoma Tax Commission, the Department of Public\n\nSafety, and Service Oklahoma shall cooperate with the Insurance\n\nDepartment in the ongoing improvement and maintenance of the\n\nverification system;\n\n2. The verification system shall be accessible through the\n\nInternet, World Wide Web or a similar proprietary or common carrier\n\nelectronic system by authorized personnel of the Department of\n\nPublic Safety, the Tax Commission, Service Oklahoma, the district\n\nattorneys, the courts, law enforcement personnel, and any other\n\nentities authorized by the Insurance Department;\n\n3. The verification system shall provide for direct inquiry and\n\nresponse between the Insurance Department and insurance carriers, or\n\nsuch other method of inquiry and response as agreed to by the\n\nInsurance Department and individual insurance carriers, and direct\n\naccess to insurers' records by personnel authorized by the Insurance\n\nDepartment;\n\n4. The verification system shall be available twenty-four (24)\n\nhours a day to verify the insurance status of any vehicle registered\n\nin this state through the vehicle's identification number, policy\n\nnumber, registered owner's name or other identifying characteristic\n\nor marker as prescribed by the Insurance Department in its rules;\n\n5. The Insurance Department may contract with a private vendor\n\nto assist in establishing and maintaining the verification system;\n\n6. The verification system shall include appropriate\n\nprovisions, consistent with industry standards, to secure its data\n\nagainst unauthorized access and to maintain a record of all\n\ninformation requests;\n\n7. Information contained in the verification system shall not\n\nbe considered a public record;\n\n8. Any law enforcement officer, to establish compliance with\n\nthe Compulsory Insurance Law during a traffic stop or accident\n\ninvestigation, shall access information from the online verification\n\nsystem to verify the current validity of the policy described on a\n\nsecurity verification form produced by the operator of each motor\n\nvehicle during the traffic stop or accident investigation. If\n\ncompliance is not confirmed for the policy described on the security\n\nverification form produced by the operator and a subsequent\n\ninvestigation conducted by the officer verifies that the operator is\n\nnot in compliance, the officer may issue a citation to the operator\n\nfor failure to comply with the Compulsory Insurance Law;\n\n9. If the operator fails to produce the security verification\n\nform during a traffic stop or accident investigation, the requesting\n\nlaw enforcement officer shall access information from the online\n\nverification system through the vehicle's identification number,\n\nregistered owner's name, license plate number or other identifying\n\ncharacteristic or marker to verify valid and current security and\n\nestablish compliance with the Compulsory Insurance Law and shall not\n\nissue a citation if valid and current security is established. If\n\nthe operator fails to produce the security verification form and\n\ncompliance is not confirmed through the online verification system,\n\nthe officer may issue a citation to the operator for failure to\n\ncomply with the Compulsory Insurance Law;\n\n10. Establishing compliance with the Compulsory Insurance Law\n\nthrough the online verification system shall not be the primary\n\ncause for law enforcement to stop a motor vehicle; and\n\n11. All information exchanged between the Insurance Department\n\nand insurance companies, any database created, and all reports,\n\nresponses, or other information generated for the purposes of the\n\nverification system shall not be subject to the Oklahoma Open\n\nRecords Act.\nce Law\n\nthrough the online verification system shall not be the primary\n\ncause for law enforcement to stop a motor vehicle; and\n\n11. All information exchanged between the Insurance Department\n\nand insurance companies, any database created, and all reports,\n\nresponses, or other information generated for the purposes of the\n\nverification system shall not be subject to the Oklahoma Open\n\nRecords Act.\n\nB. This section shall not apply to a policy issued pursuant to\n\nparagraph 3 of subsection A of Section 7-601.1 of this title or\n\nparagraph 3 of subsection A of Section 7-602 of this title to insure\n\na commercial motor vehicle or to insure any vehicle under a\n\ncommercial policy that provides commercial auto coverage as defined\n\nin Section 7-600 of this title.\n\nC. As a condition for writing motor vehicle liability policies\n\nin this state, insurance carriers shall cooperate with the Insurance\n\nDepartment in establishing and maintaining the insurance\n\nverification system and shall provide access to motor vehicle\n\ninsurance policy status information as provided in the rules of the\n\nInsurance Department.
