Every owner of a motor vehicle registered in this state,\n\nother than a licensed used motor vehicle dealer, shall, at all\n\ntimes, maintain in force with respect to such vehicle security for\n\nthe payment of loss resulting from the liability imposed by law for\n\nbodily injury, death and property damage sustained by any person\n\narising out of the ownership, maintenance, operation or use of the\n\nvehicle. Every person, while operating or using a motor vehicle\n\nregistered in this state which is not owned by the person, shall\n\nmaintain in force security for the payment of loss resulting from\n\nthe liability imposed by law for bodily injury, death or property\n\ndamage sustained by any person arising out of the operation or use\n\nof the vehicle, unless the security has been provided by the owner\n\nin accordance with this section which does not exclude the person\n\nfrom coverage.\n\nB. 1. Unless otherwise provided by law, no motor vehicle shall\n\nbe operated in this state unless there is in effect with respect to\n\nthe vehicle security for the payment of loss resulting from the\n\nliability imposed by law for bodily injury, death and property\n\ndamage sustained by any person arising out of the ownership,\n\nmaintenance, operation or use of the vehicle. Every person, while\n\noperating or using a motor vehicle in this state which is not owned\n\nby the person, shall maintain in force security for the payment of\n\nloss resulting from the liability imposed by law for bodily injury,\n\ndeath or property damage sustained by any person arising out of the\n\noperation or use of the vehicle, unless the security has been\n\nprovided by the owner in accordance with this section which does not\n\nexclude the person from coverage. Proof of security shall be\n\ncarried in the vehicle at all times and shall be produced for\n\ninspection upon request by any law enforcement officer or\n\nrepresentative of the Department of Public Safety and, in case of\n\nan accident, the proof shall be shown upon request of any person\n\naffected by the accident.\n\n2. The nonresident owner of a motor vehicle not registered in\n\nthis state may give proof of financial responsibility by providing\n\nproof of financial responsibility which is in compliance with the\n\nlaws of the state in which the vehicle is registered or by filing\n\nwith the Department a certificate of an insurance company authorized\n\nto transact insurance in the state in which the vehicle is\n\nregistered, or if the nonresident does not own a motor vehicle, then\n\nin the state in which the insured resides, provided the certificate\n\notherwise conforms to the provisions of this article, and the\n\nDepartment shall accept the certificate upon condition that the\n\ninsurance company complies with the following provisions with\n\nrespect to the policy so certified:\n\na. the insurance company shall execute a power of\n\nattorney authorizing the Department to accept service\n\non its behalf or notice of process in any action\n\narising out of a motor vehicle accident in this state,\n\nand\n\nb. the insurance company shall agree in writing that its\n\npolicies shall be deemed to conform with the laws of\n\nthis state relating to the terms of motor vehicle\n\nliability policies issued in this state.\n\n3. The provisions of this subsection shall apply to nonresident\n\nowners and operators of vehicles that are not registered in this\n\nstate only if the state in which the vehicle is registered requires\n\ncompulsory liability insurance.
