Stat. tit. 47, § 47-7-605","heading":"Suspension of driving privilege and registration - Proof","body":"of security - Seizure of driver license and vehicle - Other\n\npenalties - Immunity.\n\nA. 1. Whenever any person forfeits a bond, fails to appear, or\n\nis convicted in any state or municipal court for permitting the\n\noperation in this state of a motor vehicle owned by the person\n\nwithout the security required by this title, for operating a motor\n\nvehicle in this state without the security required by this title,\n\nor for failure to carry a security verification form, the Department\n\nof Public Safety shall suspend the driving privilege of the person.\n\n2. The suspension of the driving privilege shall remain in\n\neffect until payment is made of the fees provided for in Section 6-\n\n212 of this title and proof of security is furnished to the\n\nDepartment of Public Safety which complies with the requirements of\n\nthe Compulsory Insurance Law; provided, for purposes of this\n\nsection, proof of security shall not mean a binder policy but shall\n\nmean an owner’s policy or an operator’s policy, as defined in\n\nSection 7-600 of this title; provided further, a suspension for\n\nfailure to appear shall remain in effect until proof of appearance\n\nis received by the Department from the reporting court. Suspension\n\nunder this section shall be effective when notice thereof is given\n\npursuant to Section 2-116 of this title.\n\n3. Any person whose driving privilege has been suspended\n\npursuant to the provisions of this subsection shall surrender to the\n\nDepartment his or her driver license. Any person failing to\n\nvoluntarily relinquish his or her driver license to the Department\n\nwithin thirty (30) days of receipt of the notice specified in\n\nparagraph 2 of this subsection shall pay a fee of Fifty Dollars\n\n($50.00) in addition to the fees provided for in Section 6-212 of\n\nthis title.\n\n4. If a person furnishes proof to the satisfaction of the\n\nDepartment that security was in effect at the time of the alleged\n\noffense, the Department shall vacate the suspension order and shall\n\nnot require the filing of a certificate of insurance nor payment of\n\neither of the above fees.\n\nB. 1. When suspending the driving privilege for violation of\n\nthe Compulsory Insurance Law, or for violation of a municipal\n\nordinance requiring security or the carrying of a security\n\nverification form, the Department may rely upon court records which\n\nindicate that a person was either convicted or failed to appear upon\n\nthe charge when the record is obtained from any court of competent\n\njurisdiction which indicates one of the following:\n\na. a conviction, or\n\nb. a notice of bond forfeiture.\n\n2. A court record is sufficient under paragraph 1 of this\n\nsubsection which includes a statement such as \"No Security Form\",\n\n\"No Insurance\" or other term indicating lack of security.\n\n3. The Department may continue to rely on such records until\n\nproof is submitted from the issuing court clerk which indicates that\n\nthe record either:\n\na. was issued in error, or\n\nb. was not related to a violation of:\n\n(1) the Compulsory Insurance Law,\n\n(2) a security verification form as required by this\n\narticle, or\n\"No Security Form\",\n\n\"No Insurance\" or other term indicating lack of security.\n\n3. The Department may continue to rely on such records until\n\nproof is submitted from the issuing court clerk which indicates that\n\nthe record either:\n\na. was issued in error, or\n\nb. was not related to a violation of:\n\n(1) the Compulsory Insurance Law,\n\n(2) a security verification form as required by this\n\narticle, or\n\n(3) a municipal ordinance requiring security or the\n\ncarrying of a security verification form.\n\nC. If a nonresident's driving privilege is suspended pursuant\n\nto subsection A of this section, the Department shall transmit\n\nnotice of the suspension to the licensing agency in the state in\n\nwhich the nonresident resides.\n\nD. Whenever any person’s driving privilege has been suspended\n\npursuant to this section or Section 7-612 of this title, the\n\nDepartment may notify any law enforcement officer of the suspension.\n\nAny law enforcement officer who has been notified that the driving\n\nprivilege of a person has been suspended, upon observing the person\n\nor motor vehicle anywhere upon a public street, highway, roadway,\n\nturnpike, or public parking lot, shall stop the person or motor\n\nvehicle, seize the driver license of the person, seize the vehicle\n\nbeing operated by the person and cause the vehicle to be towed and\n\nstored as provided in subsection B of Section 955 of this title, if\n\nthe officer has probable cause to believe that the vehicle is not\n\ninsured as required by the Compulsory Insurance Law of this state.\n\nE. No person shall have a property interest in a driver license\n\nissued pursuant to the laws of this state and it shall be the duty\n\nof every person whose driving privilege has been suspended to\n\nforthwith surrender his or her driver license upon the request of\n\nany law enforcement officer or representative of the Department.\n\nF. Any person upon a public street, highway, roadway, turnpike,\n\nor public parking lot, within this state, who willfully refuses to\n\nsurrender possession of a driver license after being informed by a\n\npeace officer or representative of the Department that his or her\n\ndriving privilege is currently under suspension according to the\n\nrecords of the Department, shall be guilty of a misdemeanor,\n\npunishable as provided in Section 17-101 of this title.\n\nG. Any driver license surrendered to or seized by a law\n\nenforcement officer pursuant to the Compulsory Insurance Law shall\n\nbe submitted to a representative of the Department in a manner and\n\nwith a form or method approved by the Department.\n\nH. The Department shall deposit fees collected pursuant to\n\nparagraph 3 of subsection A of this section or pursuant to\n\nsubsection E of Section 7-612 of this title in a special account of\n\nthe Department maintained with the office of the State Treasurer.\n\nThe State Treasurer shall credit these fees to this special account\n\nto be distributed as hereinafter provided.\n\nI. The Department shall identify the name of the employing law\n\nenforcement agency from which a suspended driver license has been\n\nreceived pursuant to this section, and determine that the fee\n\nrequired by paragraph 3 of subsection A of this section has been\n\npaid. The Department shall reimburse the law enforcement agency so\n\nidentified the sum of Twenty-five Dollars ($25.00) for each driver\n\nlicense from the special account.\n\nJ. Any unencumbered monies remaining in the special account at\n\nthe close of each calendar month shall be transferred by the\n\nDepartment to the General Revenue Fund of the State Treasury.\n\nK. The State of Oklahoma, the departments and agencies thereof,\n\nincluding the Department of Public Safety, all political\n\nsubdivisions, and the officers and employees of each, shall not be\n\nheld legally liable in any suit in law or in equity for any\n\nerroneous entry of a suspension upon the records of the Department,\n\nnor for the enforcement of the provisions of the Compulsory\nhe State Treasury.\n\nK.
