Stat. tit. 47, § 47-701","heading":"Guaranteed arrest bond certificates - Automobile clubs or","body":"associations.\n\n(a) Any automobile club or other association may issue\n\nguaranteed arrest bond certificates valid for one (1) year from date\n\nof issue as provided in this act in an amount not to exceed Five\n\nHundred Dollars ($500.00) on each undertaking, provided such\n\ncertificates have been fully guaranteed or reinsured by an insurer\n\nthen licensed by the Insurance Commissioner to transact surety\n\nbusiness in this state and such guarantee or reinsurance by the\n\ninsurer covers all certificates issued by the automobile club or\n\nother association during the term of the guarantee or reinsurance\n\nwritten by the insurer. Such insurer shall first file with the\n\nInsurance Commissioner an undertaking thus to become surety. Such\n\nguaranteed arrest bond certificates may be issued also in\n\nconjunction with automobile liability insurance policies by any\n\ninsurer authorized to then write automobile liability insurance\n\nwithin this state upon such insurer filing with the Insurance\n\nCommissioner an undertaking thus to become such surety.\n\n(b) Such undertaking shall be in the form prescribed by the\n\nCommissioner of Insurance and shall state the following:\n\n(1) The name and address of the automobile clubs, association or\n\ncompanies with respect to the quaranteed arrest bond certificates of\n\nwhich the surety company undertakes to be surety.\n\n(2) The unqualified obligation of the surety company to pay the\n\nfine or forfeiture in an amount not to exceed Five Hundred Dollars\n\n($500.00) of any person who, after posting a guaranteed arrest bond\n\ncertificate with respect to which the surety company has undertaken\n\nto be surety, fails to make the appearance to guarantee which, the\n\nguaranteed arrest bond certificate was posted.\n\n(3) The term \"guaranteed arrest bond certificate\" as used herein\n\nmeans any printed card or other certificate issued by an automobile\n\nclub, association or insurance company to any of its members or\n\ninsureds, which card or certificate is signed by the member or\n\ninsured and contains a printed statement that such automobile club,\n\nassociation or insurance company and a surety company or an\n\ninsurance company authorized to transact both automobile liability\n\ninsurance and surety business, guarantee the appearance of the\n\nperson whose signature appears on the card or certificate and that\n\nthey will in the event of failure of the person to appear in court\n\nat the time of trial, pay any fine or forfeiture imposed on the\n\nperson in an amount not exceeding Five Hundred Dollars ($500.00).\n\n(c) Any guaranteed arrest bond certificate with respect to which\n\na surety company has become surety, or a guaranteed arrest bond\n\ncertificate issued by an insurance company authorized to transact\n\nboth automobile liability insurance and surety business within this\n\nstate, as herein provided, shall, when posted by the person whose\n\nsignature appears thereon, be accepted in lieu of cash bail or other\n\nbond in an amount not to exceed Five Hundred Dollars ($500.00) as a\n\nbail bond, to guarantee the appearance of such person in any court\n\nin this state, including all municipal courts in this state, at such\n\ntime as may be required by such court, when the person is arrested\n\nfor violation of any motor vehicle law of this state or any motor\n\nvehicle ordinance of any municipality in this state, except for the\n\noffense of driving under the influence of intoxicating liquors or of\n\ndrugs or for any felony committed prior to the date of expiration on\n\nsuch guaranteed arrest bond certificates; provided, that any such\n\nguaranteed arrest bond certificates so posted as bail bond in any\n\ncourt in this state shall be subject to the forfeiture and\n\nenforcement provisions with respect to bail bonds in criminal cases\n\nas otherwise provided by law or as hereafter may be provided by law,\n\nand that any such guaranteed arrest bond certificate posted as a\nn\n\nsuch guaranteed arrest bond certificates; provided, that any such\n\nguaranteed arrest bond certificates so posted as bail bond in any\n\ncourt in this state shall be subject to the forfeiture and\n\nenforcement provisions with respect to bail bonds in criminal cases\n\nas otherwise provided by law or as hereafter may be provided by law,\n\nand that any such guaranteed arrest bond certificate posted as a\n\nbail bond in any municipal court of this state shall be subject to\n\nthe forfeiture and enforcement provisions, if any, of the charter or\n\nordinance of the particular municipality pertaining to bail bonds\n\nposted.\n\n(d) The State Insurance Commissioner shall notify in writing\n\neach chief of municipal police department, each county sheriff and\n\neach judge of the district court of this state, the name of each\n\nsurety, insurance company, automobile club or association authorized\n\nto issue guaranteed arrest bond certificates, as provided in this\n\nact. The Insurance Commissioner shall also inform such officials of\n\neach additional organization which may thereafter become qualified\n\nto issue such certificates and in the event any such organization\n\nshall be disqualified from issuing such certificates, the\n\nCommissioner shall forthwith inform such officials of such\n\ndisqualification.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"93adc78ae03ccbdfc50a829711d7beded34164e0e176c7e5cb6038360e6e810e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-7-700","next":"us-ok/okla.-stat.-tit.-47-47-702"},"notice":"GroundRules: Original legal text.
