Stat. tit. 47, § 47-702","heading":"Guaranteed arrest bond certificates - Trucking","body":"associations.\n\n(a) Any trucking association may issue guaranteed arrest bond\n\ncertificates valid for one (1) year from January 1 of the year of\n\nissue as provided in this act in an amount not to exceed One\n\nThousand Dollars ($1,000.00) on each undertaking, provided such\n\ncertificates have been fully guaranteed by the trucking association\n\nor reinsured by an insurer then licensed by the Insurance\n\nCommissioner to transact surety business in this state and such\n\nguarantee or reinsurance by the insurer covers all certificates\n\nissued by the trucking association or other association during the\n\nterm of the guarantee or reinsurance written by the insurer. Such\n\ninsurer shall first file with the Insurance Commissioner an\n\nundertaking thus to become surety. The guarantee by the trucking\n\nassociation shall, at the discretion of the Insurance Commissioner,\n\nbe secured by a deposit with the Insurance Commissioner of up to\n\nFifty Thousand Dollars ($50,000.00), either cash or bond at the\n\ndiscretion of the Commissioner, to guarantee performance of said\n\nundertaking. Such guaranteed arrest bond certificates may be issued\n\nalso in conjunction with automobile liability policies by any\n\ninsurer authorized to then write automobile liability insurance\n\nwithin this state upon such insurer filing with the Insurance\n\nCommissioner an undertaking thus to become such surety.\n\n(b) Such undertaking shall be in the form prescribed by the\n\nCommissioner of Insurance and shall state the following:\n\n(1) The name and address of the trucking association,\n\nassociation or companies with respect to the guaranteed arrest bond\n\ncertificates of which the surety company undertakes to be surety.\n\n(2) The unqualified obligation of the surety company to pay the\n\nfine or forfeiture in an amount not to exceed One Thousand Dollars\n\n($1,000.00) of any person who, after posting a guaranteed arrest\n\nbond certificate with respect to which the surety company has\n\nundertaken to be surety, fails to make the appearance to guarantee\n\nwhich, the guaranteed arrest bond certificate was posted.\n\n(3) The term \"guaranteed arrest bond certificate\" as used herein\n\nmeans any printed card or other certificate issued by a trucking\n\nassociation, association or insurance company to any of its members\n\nor insured, which card or certificate is signed by the member or\n\ninsured and contains a printed statement that such trucking\n\nassociation, association or insurance company and a surety company\n\nor an insurance company authorized to transact automobile liability\n\ninsurance business, guarantee the appearance of the person whose\n\nsignature appears on the card or certificate and that they will, in\n\nthe event of failure of the person to appear in court at the time of\n\ntrial, pay any fine or forfeiture imposed on the person in an amount\n\nnot exceeding One Thousand Dollars ($1,000.00).\ncompany\n\nor an insurance company authorized to transact automobile liability\n\ninsurance business, guarantee the appearance of the person whose\n\nsignature appears on the card or certificate and that they will, in\n\nthe event of failure of the person to appear in court at the time of\n\ntrial, pay any fine or forfeiture imposed on the person in an amount\n\nnot exceeding One Thousand Dollars ($1,000.00).\n\n(c) Any guaranteed arrest bond certificate with respect to which\n\na surety company has become surety, or a guaranteed arrest bond\n\ncertificate issued by an insurance company authorized to transact\n\nautomobile liability insurance business within this state, as herein\n\nprovided, shall, when posted by the person whose signature appears\n\nthereon, be accepted in lieu of cash bail or other bond in an amount\n\nnot to exceed One Thousand Dollars ($1,000.00) as a bail bond, to\n\nguarantee the appearance of such person in any court in this state,\n\nincluding all municipal courts in this state, at such time as may be\n\nrequired by such court, when the person is arrested for violation of\n\nany motor vehicle law of this state or any motor vehicle ordinance\n\nof any municipality in this state, committed prior to the date of\n\nexpiration on such guaranteed arrest bond certificates, except for\n\nthe offense of driving under the influence of intoxicating liquors\n\nor of drugs or for any felony; provided, that any such guaranteed\n\narrest bond certificates so posted as bail bond in any court in this\n\nstate shall be subject to the forfeiture and enforcement provisions\n\nwith respect to bail bonds in criminal cases as otherwise provided\n\nby law or as hereafter may be provided by law, and that any such\n\nguaranteed arrest bond certificate posted as a bail bond in any\n\nmunicipal court of this state shall be subject to the forfeiture and\n\nenforcement provisions, if any, of the charter or ordinance of the\n\nparticular municipality pertaining to bail bonds posted.\n\n(d) The State Insurance Commissioner shall notify in writing the\n\nState Commissioner of Public Safety, each chief of municipal police\n\ndepartment, each county sheriff of this state, the name of each\n\nsurety, insurance company, trucking association, or association\n\nauthorized to issue guaranteed arrest bond certificates, as provided\n\nin this act. The Insurance Commissioner shall also inform such\n\nofficials of each additional organization which may thereafter\n\nbecome qualified to issue such certificates and in the event any\n\nsuch organization shall be disqualified from issuing such\n\ncertificates, the Commissioner shall forthwith inform such officials\n\nof such disqualification, at least ten (10) days prior to such\n\ndisqualification.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7d48fd2dc02967df26582230562f8565ba8ecb9d1a3631114612966b6c7049bd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-701","next":"us-ok/okla.-stat.-tit.-47-47-751"},"notice":"GroundRules: Original legal text.
