Stat. tit. 47, § 47-952","heading":"Rulemaking authority - Requests for service by political","body":"subdivisions - Official rotation logs.\n\nA. Except for the rates established by the Corporation\n\nCommission and other provisions as provided for by law, the\n\nDepartment of Public Safety shall have the power and authority\n\nnecessary to license, supervise, govern and control wrecker vehicles\n\nand wrecker or towing services.\n\nB. The Department of Public Safety shall adopt and prescribe\n\nsuch rules as are necessary to carry out the intent of Section 951\n\net seq. of this title.\n\nThe rules shall state the requirements for facilities, for\n\nstorage of vehicles, necessary towing equipment, the records to be\n\nkept by operators, liability insurance and insurance covering the\n\nvehicle and its contents while in storage in such sum and with such\n\nprovisions as the Department deems necessary to adequately protect\n\nthe interests of the public, and such other matters as the\n\nDepartment may prescribe for the protection of the public.\n\nC. Unless otherwise regulated by the governing body of the\n\npolitical subdivision, the wrecker vehicle used to perform wrecker\n\nor towing services requested by a political subdivision of this\n\nstate for removal of a vehicle from public property for reasons\n\nlisted in Section 955 of this title shall be from the licensed\n\nwrecker or towing service whose location is nearest to the vehicle\n\nto be towed. Requests for service may be alternated or rotated\n\namong all such licensed wrecker or towing services which are located\n\nwithin a reasonable radius of each other. In cities of less than\n\nfifty thousand (50,000) population, all such licensed wrecker or\n\ntowing services located near or in the city limits of such cities\n\nshall be considered as being equal distance and shall be called on\n\nan equal basis as nearly as possible. The police chief of any\n\nmunicipality and the county sheriff of each county shall keep\n\nrotation logs on all requested tows, except where there are\n\ninsufficient licensed wrecker or towing services available to rotate\n\nsuch services or services are contracted after a competitive bid\n\nprocess. Rotation logs shall be made available for public\n\ninspection upon request. Any calls made from cell phones or two-way\n\nradios by any law enforcement officer or employee of any\n\nmunicipality or county to any wrecker service shall be listed on the\n\nrotation or call logs and made available for public inspection. A\n\nwrecker service shall not be removed from rotation without\n\nnotification to the wrecker operator stating the reason for removal\n\nfrom the rotation log. All notification for removal from a rotation\n\nlog shall be mailed to the wrecker service owner at least ten (10)\n\ndays before removal from the rotation log and shall state the\n\nprocedure and requirements for reinstatement.\n\nD. Except as otherwise provided in this subsection, the\n\nDepartment and any municipality, county or other political\n\nsubdivision of this state shall not place any wrecker or towing\n\nservice upon an official rotation log for the performance of\n\nservices carried out pursuant to the request of or at the direction\n\nof any officer of the Department or municipality, county or\n\npolitical subdivision unless the service meets the following\n\nrequirements:\n\n1. Principal business facilities are located within Oklahoma;\n\n2. Tow trucks are registered and licensed in Oklahoma; and\n\n3. Owner is a resident of the State of Oklahoma or the service\n\nis an Oklahoma corporation.\n\nIn the event a licensed wrecker or towing service is not located\n\nwithin a county, a wrecker or towing service that is located outside\n\nof the county or this state and does not meet the above\n\nqualifications may be placed on the rotation log for the county or\n\nany municipality or political subdivision located within the county.\n\nWhen performing services at the request of any officer, no\n\noperator or wrecker or towing service upon the rotation logs shall\n\ncharge fees in excess of the maximum rates for services performed\ned outside\n\nof the county or this state and does not meet the above\n\nqualifications may be placed on the rotation log for the county or\n\nany municipality or political subdivision located within the county.\n\nWhen performing services at the request of any officer, no\n\noperator or wrecker or towing service upon the rotation logs shall\n\ncharge fees in excess of the maximum rates for services performed\n\nwithin this state, including incorporated and unincorporated areas,\n\nas established by the Commission.\n\nE. The Department shall place a licensed Class AA wrecker\n\nservice on the Highway Patrol Rotation Log in a highway patrol troop\n\ndistrict in which the place of business and the primary storage\n\nfacility of the wrecker service are located upon written request\n\nfiled by the wrecker service with the Department. Upon further\n\nrequest of the wrecker service, the Commissioner of Public Safety or\n\nthe Department employee with statewide responsibility for\n\nadministration of wrecker services may place a wrecker service on\n\nthe Highway Patrol Rotation Log in a district adjacent to the\n\ndistrict in which the place of business and the primary storage\n\nfacility of the wrecker service are located if the wrecker service\n\nis in proximity to and within a reasonable radius of the boundary of\n\nthe district. When a wrecker service is placed on the rotation log\n\nin a district, the Department shall notify the wrecker service and\n\nthe troop commander of the district.\n\nF. The Commissioner of Public Safety or the Department employee\n\nwith statewide responsibility for administration of wrecker services\n\nshall be responsible for establishing geographical areas of rotation\n\nwithin the troop districts and for notifying each wrecker service of\n\nthe geographical areas of rotation to which the service is assigned.\n\nG.
