Stat. tit. 47, § 47-953.2","heading":"Fees and charges for storage and after-hours release by","body":"towing services or repair facilities.\n\nA. The rates established by order of the Corporation Commission\n\nshall determine the maximum fees and charges for the storage and\n\nafter-hours release of nonconsensual towed vehicles, including\n\nincorporated and unincorporated areas, by a wrecker or towing\n\nservice licensed by the Department of Public Safety and repair\n\nfacilities as defined in Section 953 of Title 15 of the Oklahoma\n\nStatutes. No wrecker or towing service or repair facilities shall\n\ncharge any fee for nonconsensual towed vehicles and storage which\n\nexceeds the maximum rates established by the Commission. Such rates\n\nshall be in addition to any other rates, fees or charges authorized,\n\nallowed or required by law, including environmental remediation fees\n\nand services.\n\nB. 1. Storage or after-hours release of a towed vehicle, or\n\nboth, provided by a wrecker or towing service or by a repair\n\nfacility shall be recorded by the operator on a bill or invoice as\n\nprescribed by rules of the Department.\n\n2. Nothing herein shall limit the right of an operator or\n\nrepair facility who has provided or caused to be provided storage or\n\nafter-hours release of a towed vehicle, or both, to require\n\nprepayment, in part or in full, or guarantee of payment of any\n\ncharges incurred for providing such services.\n\n3. This section shall not be construed to require an operator\n\nor repair facility to charge a fee for the storage or after-hours\n\nrelease, or both, of any towed vehicle.\n\n4. The operator or repair facility is authorized to collect all\n\nlawful fees in acceptable forms of payment such as through check,\n\ncredit card, automated clearing house transfer, or debit card from\n\nthe owner, lienholder or agent of the towed vehicle or insurer\n\naccepting liability for paying the claim for a vehicle or purchasing\n\nthe vehicle as a total loss vehicle from the registered owner for\n\nthe performance of any and all such services. An operator or repair\n\nfacility shall make the towed vehicle available for inspection by\n\nthe owner, lien holder, agent of the towed vehicle, or insurer\n\naccepting liability for paying the claim for a vehicle and shall\n\nrelease the vehicle from storage upon authorization from the owner,\n\nagent or lienholder of the vehicle or in the case of a total loss,\n\nthe insurer accepting liability for paying the claim for the vehicle\n\nor purchasing the vehicle where the vehicle is to be moved to an\n\ninsurance pool yard for sale.\n\nC. The rates in subsections D through F of this section shall\n\nbe applicable until superseded by rates established by the\n\nCommission.\n\nD. Outdoor Storage Rates.\n\n1. Rates in this subsection shall apply to the outdoor storage\n\nof a towed vehicle. Rates may be applied from the time the towed\n\nvehicle is brought onto the outdoor storage facility premises.\n\nRates shall apply to each calendar day of outdoor storage; provided,\n\nthe maximum twenty-four-hour fee, as provided for in this section,\n\nmay be charged for any towed vehicle which is stored for a portion\n\nof a twenty-four-hour period.\n\n2. Maximum outdoor storage rates shall be as follows:\n\nRate per Each\n\n24-hour Period or\n\nType of Towed Vehicle Portion Thereof\n\nSingle vehicle: motorcycle, automobile,\n\nor light truck up to 20 feet in length $15.00\n\nSingle vehicle or combination of vehicles\n\nover 20 feet in length but less than 30\n\nfeet in length $20.00\n\nSingle vehicle or combination of vehicles\n\nover 30 feet in length and up to 8 feet\n\nin width $25.00\n\nSingle vehicle or combination of vehicles\n\nover 30 feet in length and over 8 feet\n\nin width $35.00\n\nE. Indoor Storage Rates.\n\n1. Rates in this subsection shall apply to the indoor storage\n\nof a towed vehicle. Rates may be applied from the time the towed\n\nvehicle is brought into the indoor storage facility premises. Rates\n\nshall apply to each calendar day of indoor storage; provided, the\n\nmaximum twenty-four-hour fee, as provided for in this section, may\nn length and over 8 feet\n\nin width $35.00\n\nE. Indoor Storage Rates.\n\n1. Rates in this subsection shall apply to the indoor storage\n\nof a towed vehicle. Rates may be applied from the time the towed\n\nvehicle is brought into the indoor storage facility premises. Rates\n\nshall apply to each calendar day of indoor storage; provided, the\n\nmaximum twenty-four-hour fee, as provided for in this section, may\n\nbe charged for any towed vehicle which is stored for a portion of a\n\ntwenty-four-hour period.\n\n2. Maximum indoor storage rates shall be as follows:\n\nRate per Each\n\n24-hour Period or\n\nType of Towed Vehicle Portion Thereof\n\nSingle vehicle: motorcycle, automobile,\n\nor light truck up to 20 feet in length $25.00\n\nSingle vehicle or combination of vehicles\n\nover 20 feet in length but less than 30\n\nfeet in length $30.00\n\nSingle vehicle or combination of vehicles\n\nover 30 feet in length and up to 8 feet\n\nin width $35.00\n\nSingle vehicle or combination of vehicles\n\nover 30 feet in length and over 8 feet\n\nin width $45.00\n\n3. For purposes of this subsection, “indoor storage” means the\n\nvehicle is kept in an enclosed facility.\n\nF. After-Hours Release Rate.\n\n1. The rate in this subsection shall apply to the release of a\n\ntowed vehicle to the owner, lienholder, or agent when such release\n\noccurs at a time other than normal business hours.\n\n2. As used in this subsection:\n\na. “after-hours release rate” shall mean the rate charged\n\nfor the release of a towed vehicle between the hours\n\nof midnight and 8:00 a.m., or between the hours of\n\n4:00 p.m. and midnight Monday through Friday, or any\n\ntime on Saturday, Sunday or a national holiday, and\n\nb. “national holiday” shall mean New Year’s Day, Martin\n\nLuther King Day, George Washington’s Birthday, on the\n\nthird Monday in February, Memorial Day, Independence\n\nDay, Labor Day, Veterans Day, Thanksgiving Day and\n\nChristmas Day, and shall further include the Friday\n\nbefore such national holiday which falls on a Saturday\n\nand the Monday following such national holiday which\n\nfalls on a Sunday.\n\n3. The maximum after-hours release rate shall be Fifteen\n\nDollars ($15.00) per quarter hour for the release of any single\n\nvehicle or combination of vehicles.\n\nG. An operator or repair facility shall be required to provide\n\nreasonable documentation to substantiate all lawful fees charged the\n\nowner, lienholder, agent or insurer accepting liability for paying\n\nthe claim for the towed vehicle or purchasing the towed vehicle.\n\nFees for which the operator or repair facility is being reimbursed,\n\nor having paid to a third party, shall include copies of the invoice\n\nor other appropriate documents to substantiate the payment to the\n\nthird party.","path":["OK Code","Title 47"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os47.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c0d98c8b8b3362a41bafe982c22a1c314034a4764c694c7a41c25420d6efd9ad","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-47-47-953.1","next":"us-ok/okla.-stat.-tit.-47-47-954"},"notice":"GroundRules: Original legal text.
