The Corporation Commission is hereby authorized to assess a\n\nfee upon each wrecker or towing service licensed by the Department\n\nof Public Safety and placed upon an official rotation log, as\n\nspecified in Section 952 of Title 47 of the Oklahoma Statutes, to\n\nperform nonconsensual tows.\n\nB. Each wrecker or towing service shall pay the assessment,\n\nlevied pursuant to this section, on an annual basis.\n\nC. The assessment shall be predicated upon the number of\n\nwrecker or towing vehicles utilized by the wrecker or towing service\n\nto conduct its Department-licensed operations.\n\nD. Commencing with assessments made after June 30, 2017,\n\nfailing to pay the wrecker or towing services assessment by the due\n\ndate established by the Corporation Commission shall result in an\n\nadditional penalty of twenty-five percent (25%) per vehicle. The\n\nTransportation Division Director, or designee, may waive the penalty\n\nfor good cause shown. Failure to pay the assessment and penalty\n\nwithin thirty (30) days of the notice of penalty issued by the\n\nCorporation Commission shall result in revocation of the wrecker or\n\ntowing license issued by the Department.\n\nE. Beginning fiscal year 2013, the Legislature shall establish\n\nbudgetary limits for the Commission to fulfill the duties of the\n\nNonconsensual Towing Act of 2011. The total assessments levied\n\npursuant to this section shall not exceed the amount of the\n\nbudgetary limits and indirect costs for related support functions\n\nestablished by the Legislature for any fiscal year.
