A notary public appointed and\n\ncommissioned under Section 1 of Title 49 of the Oklahoma Statutes\n\nmay perform remote online notarizations under Title 49 of the\n\nOklahoma Statutes if authorized by the Secretary of State. Before a\n\nnotary public performs the notary public's initial remote online\n\nnotarization, the notary public shall register with the Secretary of\n\nState under subsection C of this section and receive written\n\nauthorization from the Secretary of State under subsection D of this\n\nsection. An individual may apply for a commission under Section 1\n\nof Title 49 of the Oklahoma Statutes and apply for registration\n\nunder this section at the same time.\n\nB. A notary public applying to register to perform remote\n\nonline notarizations shall pay a fee of Twenty-five Dollars ($25.00)\n\nto the Secretary of State with the application. These funds shall\n\nbe deposited in the revolving fund created for the Secretary of\n\nState under Section 276.1 of Title 62 of the Oklahoma Statutes.\n\nC. A notary public registering to perform remote online\n\nnotarizations under this section shall submit a completed\n\napplication using the forms or format required by the Secretary of\n\nState that shall include:\n\n1. The full legal name of the applicant and the applicant's\n\nofficial name as it appears on the applicant's notarial commission\n\nunder Section 1 of Title 49 of the Oklahoma Statutes;\n\n2. A description of the technology the applicant intends to use\n\nin performing remote online notarizations;\n\n3. A statement that the applicant will comply with the\n\nstandards under Section 4 of this act; and\n\n4. Any other information the Secretary of State may by rule\n\nrequire.\n\nD. If the technology identified by the applicant conforms to\n\nthe standards under Section 4 of this act and the applicant has\n\nsatisfied the requirements of this section, the Secretary of State\n\nshall approve the use of the technology and issue to the applicant\n\nwritten authorization to perform remote online notarizations during\n\nthe term of the applicant's notarial commission under Section 1 of\n\nTitle 49 of the Oklahoma Statutes.\n\nE. The Secretary of State may deny a notary public's\n\napplication for registration under this section:\n\n1. For a reason for which the Secretary of State may deny,\n\nrefuse to renew or revoke a commission under subsection A of Section\n\n12 of Title 49 of the Oklahoma Statutes;\n\n2. For a violation of the rules under Section 4 of this act;\n\n3. If the technology identified by the notary public does not\n\nconform to the standards under Section 4 of this act; or\n\n4. If any information on the application is missing, inaccurate\n\nor incomplete.\n\nF. The term of a notary public's authorization to perform\n\nremote online notarizations begins on the authorization date set by\n\nthe Secretary of State and terminates on the commission's expiration\n\ndate. The renewal of a notary public's commission pursuant to\n\nSection 1 of Title 49 of the Oklahoma Statutes shall not constitute\n\nthe renewal of the notary public's authorization to perform remote\n\nonline notarizations under this section.\n\nG. A notary public's authorization to perform remote online\n\nnotarizations terminates if:\n\n1. The notary public's name changes during the term of the\n\nnotary public's commission; and\n\n2. The notary public elects to use the notary public's new name\n\nunder a new commission pursuant to paragraph 2 of subsection B of\n\nSection 11 of Title 49 of the Oklahoma Statutes.\n\nH. Nothing in this section shall be construed as prohibiting a\n\nnotary public from receiving, installing or utilizing a hardware or\n\nsoftware update to the technology that the notary public identified\n\nunder this section if the hardware or software update does not\n\nresult in a technology that is materially different from the\n\ntechnology that the notary public identified under this section.","path":["OK Code","Title 49"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os49.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d1046929a72a0716fdaabaa474f3a1c394381ade8ddba6538c1686d028c000bd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-49-49-203","next":"us-ok/okla.-stat.-tit.-49-49-205"},"notice":"GroundRules: Original legal text.
