Stat. tit. 49, § 49-206","heading":"Electronic record of remote online notarial acts","body":"ELECTRONIC RECORD OF REMOTE ONLINE NOTARIAL ACTS. A. A notary\n\npublic shall maintain a journal in a permanent, tamper-evident\n\nelectronic format complying with standards promulgated by the\n\nSecretary of State in which the notary public chronicles all remote\n\nonline notarial acts that the notary public performs. An entry in a\n\njournal shall be made contemporaneously with the performance of the\n\nremote online notarial act and contain the following information:\n\n1. The date and time of the remote online notarial act;\n\n2. A description of the document, if any, and type of notarial\n\nact;\n\n3. The full name and address of each principal for whom the\n\nnotarial act is performed;\n\n4. If the identity of the principal is based on personal\n\nknowledge, a statement to that effect;\n\n5. If identity of the principal is based on credential analysis\n\nand identity proofing, a brief description of the results of the\n\nidentity verification process and the identification credential\n\nremotely presented, including the date of issuance and expiration of\n\nthe identification credential;\n\n6. If identity of the principal is based on oath or affirmation\n\nof a credible witness, the information identified in paragraph 4 or\n\n5 of this subsection, as applicable, that provided a basis for the\n\nnotary public's identification of the credible witness, a statement\n\nof the basis by which the credible witness claims personal knowledge\n\nof the principal, the location of the credible witness, and the full\n\nname and address of the credible witness; and\n\n7. The fee, if any, charged by the notary public.\n\nB. A notary public, or a person acting on behalf of the notary\n\npublic, shall create an audio and visual recording of the\n\nperformance of each remote online notarial act.\n\nC. A notary public shall take reasonable steps to:\n\n1. Ensure the integrity, security and authenticity of remote\n\nonline notarial acts;\n\n2. Maintain a backup of the journal and the audio and visual\n\nrecording; and\n\n3. Protect the backup from unauthorized use.\n\nD. A notary public, a guardian, conservator or agent of the\n\nnotary public, or a personal representative of a deceased notary\n\npublic shall retain the journal and the audio and visual recording\n\nor cause the journal and the recording to be retained by a\n\ndepository designated by or on behalf of the person required to\n\nretain the journal and the recording. The recording shall be\n\nretained for at least ten (10) years from the date of the remote\n\nonline notarial act.
