Stat. tit. 5, § 5-9","heading":"Adverse party - Amount of liability on settlement or","body":"compromise.\n\nShould the amount of the attorney's fees be agreed upon in the\n\ncontract of employment, then such attorney's lien and cause of\n\naction against such adverse party shall be for the amount or portion\n\nof the property so agreed upon. If the fee be not fixed by contract\n\nthe lien and cause of action, as aforesaid, shall be for a\n\nreasonable amount for not only the services actually rendered by\n\nsuch attorney, but for a sum, which it might be reasonably supposed,\n\nwould have been earned by him, had he been permitted to complete his\n\ncontract, and been successful in the action, and such attorney in\n\norder to recover need not establish that his client, if the case has\n\ngone to trial, would have been successful in the action, but the\n\nfact of settlement shall be sufficient without other proof to\n\nestablish that the party making the settlement was liable in the\n\naction. Should the contract be for a contingent fee and specify the\n\namount for which action is to be filed, then the lien and cause of\n\naction, as aforesaid shall be for the amount contracted for if fixed\n\nat a definite sum of money or for the percentage of the amount or\n\nproperty sued for as mentioned in said contract where the fee is\n\nfixed on a percentage basis, not exceeding thirty-three and one-\n\nthird percent (33 1/3%) of the amount sued on where the settlement\n\nis before a verdict or judgment and if made after verdict or\n\njudgment then the full contract price.","path":["OK Code","Title 5"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os5.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f8992bc32001b6b03feaac0bf4030373d491a4c7d1a4e806408462260b246271","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-5-5-8","next":"us-ok/okla.-stat.-tit.-60-60-1"},"notice":"GroundRules: Original legal text.
