Stat. tit. 50, § 50-42","heading":"Cemeteries","body":"It shall be unlawful for any person, firm, corporation or\n\nassociation to lay out, establish, or use for burial purposes any\n\ncemetery, graveyard or burial grounds less than three-fourths (3/4)\n\nof one (1) mile from the incorporated line of any city of more than\n\nfive thousand (5,000) inhabitants within this state, or within four\n\n(4) miles from the incorporated line of any city of this state,\n\nhaving a population of more than sixty-five thousand (65,000)\n\ninhabitants, and then within three-fourths (3/4) of one (1) mile\n\nfrom any tract of land plotted into lots or blocks, or otherwise\n\nsubdivided for residence purposes, wherein lots, tracts, or blocks\n\nhave been sold in good faith for residence purposes prior to the\n\ntime of the location, opening, or use for such burial ground,\n\ngraveyard or cemetery. Provided, that where cemeteries, graveyards\n\nor burial grounds have heretofore been used and maintained within\n\nless than three-fourths (3/4) of one (1) mile from the incorporated\n\nline of any city of more than five thousand (5,000) inhabitants\n\nwithin this state, or not less than four (4) miles from the\n\nincorporated line of any city of this state, having a population of\n\nmore than sixty-five thousand (65,000) inhabitants, and not less\n\nthan three-fourths (3/4) of one (1) mile from any tract of land\n\nplotted into lots or blocks, or otherwise subdivided for residence\n\npurposes, wherein lots, tracts or blocks have been sold in good\n\nfaith for residence purposes, and additional lands are required for\n\ncemetery purposes, any person owning lands adjacent, may lay out and\n\nuse, or sell the same to such cemetery to be used as an addition to\n\nsuch cemetery, and the use of such additional lands for such\n\npurposes shall not be prohibited hereby. Provided, however, that\n\nthe provisions of this act shall not apply to the laying out,\n\nestablishing, or using for burial purposes any cemetery, graveyard\n\nor burial ground in cities containing a population over three\n\nhundred thousand (300,000), according to the preceding Federal\n\nDecennial Census, whenever authority for such construction and\n\noperation has been obtained from a governmental planning commission\n\nhaving jurisdiction over zoning and building regulations covering\n\nthe area wherein such cemetery, or burial ground is proposed to be\n\nlocated.","path":["OK Code","Title 50"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os50.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a87b212e6a70b8f877be0b3b1a5a395600191668b3755d362bd092366a6b4886","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-50-50-41","next":"us-ok/okla.-stat.-tit.-50-50-42.1"},"notice":"GroundRules: Original legal text.
