Stat. tit. 51, § 51-131","heading":"Referenda and certification","body":"(a) With respect to employees of the state in positions covered\n\nby a retirement system established by the state, the Governor is\n\nempowered to authorize a referendum upon the question of whether\n\nservice in positions covered by such retirement system should be\n\nexcluded from or included under an agreement, or modification\n\nthereof, under Section 123 of this title; and, with respect to\n\nemployees of any political subdivision or instrumentality in\n\npositions covered by a retirement system established by the state or\n\nby such subdivision or instrumentality, the Governor, upon written\n\nrequest of the governing body of such subdivision or\n\ninstrumentality, shall authorize a referendum upon the question of\n\nwhether positions covered by such retirement system should be\n\nexcluded from or included under a plan submitted by such subdivision\n\nor instrumentality under Section 125 of this title. In either case\n\nthe referendum shall be conducted, and the Governor shall designate\n\nan agency or individual to supervise its conduct, in accordance with\n\nthe requirement of Section 218(d) (3) of the Federal Social Security\n\nAct; and the notice of referendum required by said Section 218(d)\n\n(3) of the Federal Social Security Act shall contain, or shall be\n\naccompanied by, a statement in such form and in such detail as the\n\nagency or individual designated by the Governor to conduct such\n\nreferendum shall deem necessary to inform the eligible employees of\n\nthe rights which will accrue to them and their dependents and\n\nsurvivors, and the liabilities to which they will be subject, in\n\nevent their services are included under such an agreement or plan.\n\n(b) Upon receiving evidence satisfactory to him that, with\n\nrespect to any such referendum, the conditions specified in Section\n\n218(d) (3) of the Federal Social Security Act have been met, the\n\nGovernor shall so certify to the appropriate federal agency.\n\n(c) Nothing in this section shall be construed as allowing or\n\nproviding for coverage of services in a policeman's or fireman's\n\nposition, unless and until the Federal Social Security Act be\n\namended to allow coverage of services in such a position.","path":["OK Code","Title 51"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os51.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3f02d4f6b175b54a0de4fff4fefe23c290f161261ce65e2264ec7b020603c685","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-51-51-130","next":"us-ok/okla.-stat.-tit.-51-51-132"},"notice":"GroundRules: Original legal text.
