The state or a political subdivision shall be liable for\n\nloss resulting from its torts or the torts of its employees acting\n\nwithin the scope of their employment subject to the limitations and\n\nexceptions specified in The Governmental Tort Claims Act and only\n\nwhere the state or political subdivision, if a private person or\n\nentity, would be liable for money damages under the laws of this\n\nstate. The state or a political subdivision shall not be liable\n\nunder the provisions of The Governmental Tort Claims Act for any act\n\nor omission of an employee acting outside the scope of the\n\nemployee's employment.\n\nB. The liability of the state or political subdivision under\n\nThe Governmental Tort Claims Act shall be exclusive and shall\n\nconstitute the extent of tort liability of the state, a political\n\nsubdivision or employee arising from common law, statute, the\n\nOklahoma Constitution, or otherwise. If a court of competent\n\njurisdiction finds tort liability on the part of the state or a\n\npolitical subdivision of the state based on a provision of the\n\nOklahoma Constitution or state law other than The Governmental Tort\n\nClaims Act, the limits of liability provided for in The Governmental\n\nTort Claims Act shall apply.\n\nC. If an action is commenced alleging tort liability on the\n\npart of the state or a political subdivision of the state or an\n\nemployee of the state or of a political subdivision of the state\n\nbased on a provision of the Oklahoma Constitution or state law other\n\nthan The Governmental Tort Claims Act, the action shall name as\n\ndefendant the state or political subdivision against which liability\n\nis sought to be established.
