Any information, records or other material heretofore\n\nvoluntarily supplied to any state agency, board or commission shall\n\nbe subject to full disclosure pursuant to Section 24A.1 et seq. of\n\nthis title.\n\nB. If disclosure would give an unfair advantage to competitors\n\nor bidders, a public body may keep confidential records relating to:\n\n1. Bid specifications for competitive bidding prior to\n\npublication by the public body;\n\n2. Contents of sealed bids prior to the opening of bids by a\n\npublic body;\n\n3. Computer programs or software but not data thereon;\n\n4. Appraisals relating to the sale or acquisition of real\n\nestate by a public body prior to award of a contract; or\n\n5. The prospective location of a private business or industry\n\nprior to public disclosure of such prospect except for records\n\notherwise open to inspection such as applications for permits or\n\nlicenses.\n\nC. Except as set forth hereafter, the Oklahoma Department of\n\nCommerce, the Oklahoma Department of Career and Technology\n\nEducation, the technology center school districts, the Oklahoma Film\n\nand Music Office, institutions within the Oklahoma State System of\n\nHigher Education and the Department of Corrections may keep\n\nconfidential:\n\n1. Business plans, feasibility studies, financing proposals,\n\nmarketing plans, financial statements or trade secrets submitted by\n\na person or entity seeking economic advice, business development or\n\ncustomized training from such Departments or school districts;\n\n2. Proprietary information of the business submitted to the\n\nDepartment or school districts for the purpose of business\n\ndevelopment or customized training, and related confidentiality\n\nagreements detailing the information or records designated as\n\nconfidential; and\n\n3. Information compiled by such Departments or school districts\n\nin response to those submissions.\n\nThe Oklahoma Department of Commerce, the Oklahoma Department of\n\nCareer and Technology Education, the technology center school\n\ndistricts, the Oklahoma Film and Music Office, institutions within\n\nthe Oklahoma State System of Higher Education and the Department of\n\nCorrections may not keep confidential that submitted information\n\nwhen and to the extent the person or entity submitting the\n\ninformation consents to disclosure.\n\nD. Although they must provide public access to their records\n\nincluding records of the address, rate paid for services, charges,\n\nconsumption rates, adjustments to the bill, reasons for adjustment,\n\nthe name of the person that authorized the adjustment and payment\n\nfor each customer, public bodies that provide utility services to\n\nthe public shall keep confidential and shall redact from any record,\n\npersonal email addresses, credit information, credit card numbers,\n\ntelephone numbers, social security numbers, bank account information\n\nfor individual customers and any portion of any record that contains\n\nthe name or any other identifier of the occupants of any residential\n\nstructure. Public bodies that provide utility services to the\n\npublic may keep confidential utility supply and utility equipment\n\nsupply contracts for any industrial customer with a connected\n\nelectric load in excess of two thousand five hundred (2,500)\n\nkilowatts if public access to such contracts would give an unfair\n\nadvantage to competitors of the customer; provided that, where a\n\npublic body performs billing or collection services for a utility\n\nregulated by the Corporation Commission pursuant to a contractual\n\nagreement, any customer or individual payment data obtained or\n\ncreated by the public body in performance of the agreement shall not\n\nbe a record for purposes of the Oklahoma Open Records Act.","path":["OK Code","Title 51"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os51.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7e85fa14f26279047fe3c436d833981aad0511d97bc24ca0baad9307b81029b7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-51-51-24a.1","next":"us-ok/okla.-stat.-tit.-51-51-24a.10a"},"notice":"GroundRules: Original legal text.
