Except as set forth in subsection B of this section, public\n\neducational institutions and their employees may keep confidential:\n\n1. Individual student records;\n\n2. Teacher lesson plans, tests and other teaching material;\n\n3. Personal communications concerning individual students; and\n\n4. Any contract for use of a student athlete’s name, image, or\n\nlikeness disclosed to a postsecondary institution pursuant to the\n\nStudent Athlete Name, Image and Likeness Rights Act.\n\nB. If kept, statistical information not identified with a\n\nparticular student and directory information shall be open for\n\ninspection and copying. Except as provided in subsection C of this\n\nsection, each educational institution may choose to designate\n\nspecific information which shall be classified as directory\n\ninformation for students attending the educational institution. In\n\naccordance with the Family Educational Rights and Privacy Act,\n\nSection 1232g of Title 20 of the United States Code and Part 99 of\n\nTitle 34 of the Code of Federal Regulations, “directory information”\n\nincludes a student’s name, address, telephone listing, date and\n\nplace of birth, major field of study, participation in officially\n\nrecognized activities and sports, weight and height of members of\n\nathletic teams, dates of attendance, degrees and awards received,\n\nand the most recent previous educational institution attended by the\n\nstudent. Any educational agency or institution making public\n\ndirectory information shall give public notice of the categories of\n\ninformation which it has designated as directory information with\n\nrespect to each student attending the institution or agency and\n\nshall allow a reasonable period of time after the notice has been\n\ngiven for a parent to inform the institution or agency that any or\n\nall of the information designated should not be released without\n\nprior consent of the parent or guardian or the student if the\n\nstudent is eighteen (18) years of age or older.\n\nC. All educational agencies or institutions which are not the\n\nprimary custodians of student directory information of students\n\nattending the educational institution, but which are allowed to\n\naccess the information for educational purposes, shall be prohibited\n\nfrom releasing or selling any or all student directory information\n\nunless disclosure is authorized by the Family Educational Rights and\n\nPrivacy Act, Section 1232g of Title 20 of the United States Code and\n\nPart 99 of Title 34 of the Code of Federal Regulations, or Section\n\n3-168 of Title 70 of the Oklahoma Statutes.\n\nD.
