The following information may be kept confidential:\n\n1. Investigative evidence of a plan or scheme to commit an act\n\nof terrorism;\n\n2. Assessments of the vulnerability of government facilities or\n\npublic improvements to an act of terrorism and work papers directly\n\nrelated to preparing the assessment of vulnerability;\n\n3. Records including details for deterrence or prevention of or\n\nprotection from an act or threat of an act of terrorism;\n\n4. Records including details for response or remediation after\n\nan act of terrorism;\n\n5. Information technology of a public body or public official\n\nbut only if the information specifically identifies:\n\na. design or functional schematics that demonstrate the\n\nrelationship or connections between devices or\n\nsystems,\n\nb. system configuration information,\n\nc. security monitoring and response equipment placement\n\nand configuration,\n\nd. specific location or placement of systems, components,\n\nor devices,\n\ne. system identification numbers, names, or connecting\n\ncircuits,\n\nf. business continuity and disaster planning, or response\n\nplans, or\n\ng. investigative information directly related to security\n\npenetrations or denial of services;\n\n6. Investigation evidence of an act of terrorism that has\n\nalready been committed;\n\n7. Records received, maintained, or generated by the Oklahoma\n\nOffice of Homeland Security which include confidential private\n\nbusiness information or an individual’s private records;\n\n8. Records received by the Oklahoma Office of Homeland Security\n\nfrom the United States Department of Homeland Security or records\n\nmaintained or generated by the Oklahoma Office of Homeland Security\n\ninvolving the United States Department of Homeland Security;\n\n9. Records received, maintained, or generated by the Department\n\nof Environmental Quality that contain information regarding sources\n\nof radiation in quantities determined by the United States Nuclear\n\nRegulatory Commission to be significant to public health and safety,\n\nby whomever possessed, whether in transit or at fixed sites, when\n\nthe information could reasonably be expected to have an adverse\n\neffect on the health and safety of the public by increasing the\n\nlikelihood of theft, diversion, or sabotage of the radiation sources\n\nor facilities. The information may include but is not limited to\n\ninformation:\n\na. from or relating to radioactive material licensees\n\nidentifying the exact location of the radioactive\n\nmaterial,\n\nb. describing how the radioactive material is secured\n\nfrom unauthorized removal or access when it is in\n\nstorage,\n\nc. describing the control and maintenance of constant\n\nsurveillance of the radioactive material when it is\n\nnot in storage,\n\nd. describing specific policies and procedures for\n\nactions to physically protect the radioactive\n\nmaterial,\n\ne. identifying possession limits or actual inventories of\n\nradionuclides,\n\nf. containing or describing assessments or analyses that\n\ncould reveal vulnerabilities,\n\ng. identifying specific locations of safety and security\n\nequipment,\n\nh. describing emergency planning, emergency response and\n\nfire protection, and\n\ni. containing or describing other information that could\n\nreasonably be expected to be useful to persons with\n\nmalevolent intent;\n\n10. The names of school district personnel who have been\n\ndesignated to carry a firearm pursuant to Section 5-149.2 of Title\n\n70 of the Oklahoma Statutes;\n\n11. Information technology of the State Election Board or a\n\ncounty election board which is determined jointly by the Secretary\n\nof the State Election Board and the State Chief Information Officer\n\nto be technology that could reasonably be expected to be useful to\n\npersons with intent to interfere with the conduct of an election,\n\nvoter registration, or other election processes;\n\n12. Records received, maintained, or generated by the Oklahoma\nion Board or a\n\ncounty election board which is determined jointly by the Secretary\n\nof the State Election Board and the State Chief Information Officer\n\nto be technology that could reasonably be expected to be useful to\n\npersons with intent to interfere with the conduct of an election,\n\nvoter registration, or other election processes;\n\n12. Records received, maintained, or generated by the Oklahoma\n\nMunicipal Power Authority established pursuant to Section 24-101 et\n\nseq. of Title 11 of the Oklahoma Statutes and in its role as an\n\nelectric utility regulated by the federal government, related to\n\nsecurity plans and procedures including, but not limited to,\n\ncybersecurity matters; and\n\n13. Risk and vulnerability assessments of school districts\n\nconducted pursuant to Section 2 of this act including\n\nrecommendations to increase security on school district property and\n\nwork papers directly related to preparation of the risk and\n\nvulnerability assessments.\n\nB. The following information shall not be kept confidential:\n\n1. Records related to federal grants administered by the\n\nOklahoma Office of Homeland Security or the Department of\n\nEnvironmental Quality;\n\n2. Records related to the receipt and expenditure of public\n\nfunds; or\n\n3. Records related to the financial performance or financial\n\nadministration of the Oklahoma Office of Homeland Security or the\n\nDepartment of Environmental Quality.\n\nC. For the purposes of this section, the term “terrorism” means\n\nany act encompassed by the definitions set forth in Section 1268.1\n\nof Title 21 of the Oklahoma Statutes.\n\nD. 1. Public educational institutions may keep confidential\n\ncampus security plans. An institution or agency may in its\n\ndiscretion release information contained in or related to the campus\n\nsecurity plan in order to design or implement the plan.\n\n2. Nothing in this subsection shall preclude an institution or\n\nagency within The Oklahoma State System of Higher Education from\n\ncollecting and releasing information relating to campus crime\n\nstatistics and campus security policies as is required pursuant to\n\nthe Jeanne Clery Disclosure of Campus Security Policy and Campus\n\nCrime Statistics Act, 20 U.S.C. 1092(f).\n\n3. For purposes of this subsection, “campus security plan”\n\nshall include, but is not limited to, prevention and response\n\nprocedures to and notification procedures for perceived or actual\n\nsecurity threats and incidents on or impacting the campus.","path":["OK Code","Title 51"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os51.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3d73fc0052086651bf93588ce78b760849aff81326b71ca0ed557ba30fa96137","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-51-51-24a.27","next":"us-ok/okla.-stat.-tit.-51-51-24a.29"},"notice":"GroundRules: Original legal text.
