Stat. tit. 51, § 51-24A.3","heading":"Definitions","body":"As used in the Oklahoma Open Records Act:\n\n1. “Record” means all documents including, but not limited to,\n\nany book, paper, photograph, microfilm, data files created by or\n\nused with computer software, computer tape, disk, record, sound\n\nrecording, film recording, video record or other material regardless\n\nof physical form or characteristic, created by, received by, under\n\nthe authority of, or coming into the custody, control or possession\n\nof public officials, public bodies or their representatives in\n\nconnection with the transaction of public business, the expenditure\n\nof public funds or the administering of public property. Record\n\nshall also mean applications and other documents related to\n\nlicensure matters that are filed of record in a district court,\n\nincluding, but not limited to, marriage licenses, process server\n\nlicenses, closing out sale licenses, transient merchant licenses,\n\npool hall licenses, and bail bondsmen registration. Record does not\n\nmean:\n\na. computer software, or\n\nb. nongovernment personal effects;\n\n2. “Public body” shall include, but not be limited to, any\n\noffice, department, board, bureau, commission, agency, trusteeship,\n\nauthority, council, committee, trust or any entity created by a\n\ntrust, county, city, village, town, township, district, school\n\ndistrict, fair board, court, executive office, advisory group, task\n\nforce, study group or any subdivision thereof, supported in whole or\n\nin part by public funds or entrusted with the expenditure of public\n\nfunds or administering or operating public property, and all\n\ncommittees, or subcommittees thereof. Except for the records\n\nrequired by Section 24A.4 of this title, public body does not mean\n\njudges, justices, the Council on Judicial Complaints, the\n\nLegislature or legislators. Public body shall not include an\n\norganization that is exempt from federal income tax under Section\n\n501(c)(3) of the Internal Revenue Code of 1986, as amended, and\n\nwhose sole beneficiary is a college or university, or an affiliated\n\nentity of the college or university, that is a member of The\n\nOklahoma State System of Higher Education. Such organization shall\n\nnot receive direct appropriations from the Legislature. The\n\nfollowing persons shall not be eligible to serve as a voting member\n\nof the governing board of the organization:\n\na. a member, officer, or employee of the Oklahoma State\n\nRegents for Higher Education,\n\nb. a member of the board of regents or other governing\n\nboard of the college or university that is the sole\n\nbeneficiary of the organization, or\n\nc. an officer or employee of the college or university\n\nthat is the sole beneficiary of the organization;\n\n3. “Public office” means the physical location where public\n\nbodies conduct business or keep records;\n\n4. “Public official” means any official or employee of any\n\npublic body as defined herein; and\n\n5. “Law enforcement agency” means any public body charged with\n\nenforcing state or local criminal laws and initiating criminal\n\nprosecutions including, but not limited to: police departments;\n\nstate and local fire marshals when investigating potential\n\nviolations of federal, state, or local criminal laws or when acting\n\non behalf of a law enforcement agency; county sheriffs; the\n\nDepartment of Public Safety; the Oklahoma State Bureau of Narcotics\n\nand Dangerous Drugs Control; the Alcoholic Beverage Laws Enforcement\n\nCommission; and the Oklahoma State Bureau of Investigation.","path":["OK Code","Title 51"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os51.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1aeb03f9cd6b43c1d0eaa483dfdc502baf58fe585d585401ff8cce7f4b557231","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-51-51-24a.29","next":"us-ok/okla.-stat.-tit.-51-51-24a.30"},"notice":"GroundRules: Original legal text.
