Stat. tit. 51, § 51-5","heading":"Rights of parties in contest","body":"If there be a contest over the election, between a person\n\nholding an office, who was voted for at the polls for election, and\n\nsome other competitor for the same office, the one shown by the\n\nelection returns to have been elected, shall, after qualifying and\n\ngiving bond as required by law, and on demand, be entitled to the\n\npossession of the office, and perform the duties pending the\n\ndetermination of the contest. When the contest is determined, the\n\nsuccessful party shall, on qualifying and giving bond, and on\n\ndemand, be entitled to the office. The salary shall, after the\n\ncontest is determined, be paid to the rightful claimant of the\n\noffice, and if paid in fees, the incumbent, if defeated in the\n\ncontest, shall be liable therefor on his official bond to the\n\nrightful claimant. When the contest is determined adversely to the\n\noccupant of the office, or if the former officer was not voted for\n\nfor re-election, or does not contest the election, then he shall at\n\nonce, at the expiration of his term, and on demand, surrender the\n\noffice to the successor elected, when he has qualified and given\n\nbond as required by law, and on his failure so to surrender the\n\noffice he shall be deemed guilty of a misdemeanor, and upon\n\nconviction, shall be imprisoned in the county jail not less than\n\nthirty (30) days, nor more than six (6) months, and shall be liable\n\nto a fine of not less than Fifty Dollars ($50.00) nor more than\n\nThree Hundred Dollars ($300.00), and each and every week the officer\n\nso holds over shall be deemed a separate offense.","path":["OK Code","Title 51"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os51.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"eb75f874c75558274c1cbe2564d01981377f46feea8c4eff762f8b0f391d9af6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-51-51-46","next":"us-ok/okla.-stat.-tit.-51-51-50"},"notice":"GroundRules: Original legal text.
