Stat. tit. 51, § 51-8","heading":"Office vacant, when","body":"Every office shall become vacant on the happening of any one of\n\nthe following events before the expiration of the term of such\n\noffice:\n\nFirst. The death of the incumbent or his resignation.\n\nSecond. His removal from office or failure to qualify as\n\nrequired by law.\n\nThird. Whenever any final judgment shall be obtained against\n\nhim for a breach of his official bond.\n\nFourth. Ceasing to be a resident of the state, county,\n\ntownship, city or town, or of any district thereof, in which the\n\nduties of his office are to be exercised or for which he may have\n\nbeen elected or appointed.\n\nFifth. Conviction in a state or federal court of competent\n\njurisdiction of any felony or any offense involving a violation of\n\nhis official oath; provided, that no conviction, as a cause of\n\nvacation of office, shall be deemed complete so long as an appeal\n\nmay be pending, or until final judgment is rendered thereon.\n\nSixth. Upon entering of a plea of guilty or nolo contendere in\n\na state or federal court of competent jurisdiction for any felony or\n\nany offense involving a violation of his official oath.\n\nThe fact by reason whereof the vacancy arises shall be\n\ndetermined by the authority authorized to fill such vacancy.\n\nR.L. 1910, § 4276.
