Stat. tit. 51, § 51-98","heading":"Suspension during proceedings - Temporary appointment -","body":"Right to salary.\n\nWhen the complaint or petition for removal is filed, if in\n\naddition to the matter charged as ground for removal, the complaint\n\nshall also pray that the officer charged be suspended from office\n\npending an investigation or trial. The Supreme Court or any Judge\n\nthereof, or any district judge or court of the county of the\n\nresidence of the accused, may, upon not less than ten (10) days'\n\nnotice to the respondent, if sufficient cause appear from the\n\npetition and the affidavits or depositions then filed and presented,\n\norder the suspension of the accused from the functions of his office\n\nuntil the determination of the matter, and upon such suspension the\n\ncourt shall immediately appoint some proper and qualified person\n\ntemporarily to fill said office and perform its duties until such\n\nproceedings for removal shall be finally determined, and in the\n\nevent of the removal of the officer so suspended the vacancy shall\n\nbe filled in the manner provided by law for filling vacancies in\n\nsuch office.\n\nIf on the final hearing of the complaint or petition herein,\n\nprovided the officer is not removed from his office he shall receive\n\nthe salary allowed him by law during the time of his suspension.\n\nSuch officer so temporarily appointed shall also in any event\n\nreceive the same salary as is provided by law to be paid to the\n\nofficer filling such position.","path":["OK Code","Title 51"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os51.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"68e0c3fb3275ada04e2ea57d68578ce01c040cf42204213adfb664ca9435a520","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-51-51-97","next":"us-ok/okla.-stat.-tit.-51-51-99"},"notice":"GroundRules: Original legal text.
