Stat. tit. 52, § 52-116","heading":"Violation of orders, rules and regulations - Injunction -","body":"Appeal - Supersedeas.\n\nWhere the Commission shall make and issue any order, rule, or\n\nregulation for the prevention or prohibition of any waste prohibited\n\nby this act, or by any order, rule, or regulation of the Commission,\n\nauthorized by this act, and the same has been or is being violated\n\nby any person, firm, trust, association or corporation, the Attorney\n\nGeneral of the state, or the Proration Attorney may in the name of\n\nthe state bring an action in the district court of the county\n\nwherein the oil or gas properties have been or are being operated in\n\nviolation of such order, rule, or regulation of the Commission or\n\nwherein any such violation of any order, rule or regulation of the\n\nCommission has been or is being committed, for a prohibitory and/or\n\na mandatory injunction, enjoining and prohibiting the offender from\n\nfurther violating the provisions of this act or any such order,\n\nrule, or regulation of the Commission and/or commanding and\n\ncompelling such offender to obey such order, rule, or regulation;\n\nand such court is hereby given jurisdiction to grant such injunction\n\nor such other relief as may be proper in the premises, and shall\n\nhave power to grant in any such proceedings temporary restraining\n\norders and/or injunctions, to obtain which no bond shall be\n\nrequired. Neither a temporary nor permanent injunction granted\n\nunder the provisions of this section shall be stayed or superseded\n\non appeal therefrom except upon order of the Supreme Court, and then\n\nonly upon application therefor, and hearing thereon after reasonable\n\nnotice to plaintiff. Insofar as permitted and not prohibited by\n\nexisting statutes, all suits brought under the provisions of this\n\nsection shall be given, in the hearing and trial thereof, by all\n\ncourts in which the same are brought and prosecuted, precedence over\n\nother actions pending in said courts.\n\nAdded by 1933, c. 131, p. 295, § 33, emerg. eff.
