Stat. tit. 52, § 52-24.4","heading":"Definitions","body":"For the purposes of this act:\n\n1. “Gathering” is the transportation of natural gas through a\n\npipeline for hire, compensation or otherwise, or transporting\n\nnatural gas through a pipeline, in whole or in part, for such\n\nperson’s own account, whether in connection with the purchase and\n\nresale of natural gas, or in connection with the processing of\n\nnatural gas or otherwise, performed by a person other than a local\n\ndistribution company, intrastate transmission pipeline or interstate\n\npipeline. Gathering includes those activities or processes\n\nperformed between the delivery points and the redelivery points,\n\nwhich shall include and be limited to only transportation,\n\nmeasurement, conditioning, compressing, pressure regulation,\n\nrecompressing, cleaning and treating of such gas and the fuel or gas\n\nloss associated with such foregoing activities. The terms\n\n“conditioning, cleaning and treating” as used herein shall include\n\nthose processes of separation, dehydration, removal of all\n\ncontaminants and inerts and filtering. Gathering specifically shall\n\nnot include processing or the extraction of natural gas liquids and\n\nproducts;\n\n2. \"Gatherer\" shall mean any person who performs the activities\n\nor processes defined as gathering;\n\n3. \"Person\" shall mean any individual, corporation, firm,\n\npartnership, master limited partnership, limited liability company,\n\nassociation, venture, trust, institution, or federal, state, or\n\nlocal governmental instrumentality, or any legal entity however\n\norganized;\n\n4. \"Shipper\" shall mean any person who owns or controls natural\n\ngas that seeks or receives gathering service from a gatherer;\n\n5. \"Terms and conditions of service\" shall include all factors\n\ndefining the obligations between the gatherer and shipper respecting\n\nany gathering activities or process, including, but not limited to,\n\nnominations, deductions for fuel, accounting for imbalances,\n\nimbalance penalties, assessments, charges or makeup provisions,\n\ncosts, charges and fees for connection or maintaining connections,\n\nduration of gathering service, location of receipt and delivery\n\npoints, quality specifications of natural gas, minimum and maximum\n\npressures, and measurement;\n\n6. “Delivery point(s)” shall mean the point where the\n\npossession or control of the gas stream transfers from a shipper to\n\na gatherer;\n\n7. “Redelivery point(s)” shall mean the point at which the\n\ngatherer relinquishes possession or control of the gas stream;\n\n8. “Similarly situated shipper” shall mean any person so\n\ndesignated by the Commission, after application and hearing, wherein\n\nthe Commission determines that such applicant should receive the\n\nbenefits and obligations specified in a previously issued Commission\n\norder under this act. In determining whether a person is a\n\nsimilarly situated shipper, the Commission shall consider all\n\nrelevant conditions and factors including those utilized in fixing\n\nthe fee or terms and conditions of service in the previous order.\n\nSimilarly situated shipper status shall be limited to applicant’s\n\ninterest in the well(s) covered by the previous order; and\n\n9. “Spread fee” shall mean the monthly difference obtained by\n\nsubtracting the value received by the gatherer for the natural gas\n\nliquids attributable to shipper from the value of the heating\n\ncontent of the natural gas converted to natural gas liquids\n\nattributable to the shipper, established by the cost of natural gas\n\npurchased by the gatherer to specifically replace such heating\n\ncontent or, if no actual purchases were made, by the value received\n\nby gatherer for natural gas sold at the plant tailgate; provided,\n\nhowever, in any month that the result of this calculation generates\n\na value of zero or less, there shall be deemed to be no spread fee.","path":["OK Code","Title 52"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os52.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f1945f6f9b889b28fcfe7ed439d04aaeec0caa1c92a6a4f4f2c22724c88cb62a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-52-52-24.2","next":"us-ok/okla.-stat.-tit.-52-52-24.5"},"notice":"GroundRules: Original legal text.
