Stat. tit. 52, § 52-287.3","heading":"Matters to be found by Corporation Commission -","body":"Requisites of petition.\n\nIf upon the filing of a petition therefor and after notice and\n\nhearing, all in the form and manner and in accordance with the\n\nprocedure and requirements hereinafter provided, the Corporation\n\nCommission shall find (a) that the unitized management, operation\n\nand further development of a common source of supply of oil and gas\n\nor portion thereof is reasonably necessary in order to effectively\n\ncarry on pressure maintenance or repressuring operations, cycling\n\noperations, water flooding operations, or any combination thereof,\n\nor any other nonprimary production form of joint effort calculated\n\nto substantially increase the ultimate recovery of oil and gas from\n\nthe common source of supply; and (b) that one or more of the\n\nunitized methods of operation as applied to such common source of\n\nsupply or portion thereof are feasible, will prevent waste and will\n\nwith reasonable probability result in the increased recovery of\n\nsubstantially more oil and gas from the common source of supply than\n\nwould otherwise be recovered; and (c) that the estimated additional\n\ncost, if any, of conducting such operations will not exceed the\n\nvalue of the additional oil and gas so recovered; and (d) that such\n\nunitization and adoption of one or more of such unitized methods of\n\noperation is for the common good and will result in the general\n\nadvantage of the owners of the oil and gas rights within the common\n\nsource of supply or portion thereof directly affected, it shall make\n\na finding to that effect and make an order creating the unit and\n\nproviding for the unitization and unitized operation of the common\n\nsource of supply or portion thereof described in the order, all upon\n\nsuch terms and conditions, as may be shown by the evidence to be\n\nfair, reasonable, equitable and which are necessary or proper to\n\nprotect, safeguard, and adjust the respective rights and obligations\n\nof the several persons affected, including royalty owners, owners of\n\noverriding royalties, oil and gas payments, carried interests,\n\nmortgagees, lien claimants and others, as well as the lessees. The\n\npetition shall set forth a description of the proposed unit area\n\nwith a map or plat thereof attached, must allege the existence of\n\nthe facts required to be found by the Commission as hereinabove\n\nprovided and shall have attached thereto a recommended plan of\n\nunitization applicable to such proposed unit area and which the\n\npetitioner or petitioners consider to be fair, reasonable and\n\nequitable.","path":["OK Code","Title 52"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os52.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c313fd012a46bc4b9d8d49b218d1d8f2fc2022ac53bb0e31f21e7932a58f2078","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-52-52-287.2","next":"us-ok/okla.-stat.-tit.-52-52-287.4"},"notice":"GroundRules: Original legal text.
